According to the provisions of Article 13 of Decree 33/2023/ND-CP on the recruitment of commune-level officials:

Recruitment of commune-level officials

The recruitment of commune-level officials is governed by the regulations in the Government of Vietnam’s decree on the recruitment, usage, and management of officials, including:

1. Basis for recruiting commune-level officials.

2. Conditions for registering to apply for commune-level official positions.

Specifically, the position of Chief Commander of the Commune-level Military Command must also meet the standards specified in Article 7 and Clause 1, Article 10 of this Decree, in addition to the conditions mentioned for registering to apply for commune-level official positions.

3. Eligible individuals and preferential points in the examination or selection of commune-level officials.

Specifically, young intellectual volunteers participating in rural and mountainous area development and non-specialized workers at the commune level for 24 months or more who have been evaluated as completing the task or higher are awarded an additional 2.5 points to their Round 2 score.

4. Commune-level official recruitment committee.

5. Forms, content, and time of the commune-level official recruitment examination.

Individuals who have passed the initial quality assessment for official recruitment as regulated by the Government of Vietnam will not need to take Round 1 of the commune-level official recruitment examination as prescribed by the Government’s decree.

6. Determination of successful candidates in the commune-level official recruitment examination.

7. Eligible individuals for commune-level official selection.

The position of Chief Commander of the Commune-level Military Command will be filled by individuals who meet the criteria specified in Article 7 and Clause 1, Article 10 of this Decree and appointed according to legal provisions on militia and self-defense forces.

8. Content and forms of the commune-level official selection process.

9. Determination of successful candidates in the commune-level official selection process.

10. Announcement of recruitment and reception of application forms for commune-level official positions.

11. Procedures for organizing the recruitment of commune-level officials.

12. Announcement of commune-level official recruitment results.

13. Completion of commune-level official recruitment documents.

14. Recruitment decisions and job acceptance for commune-level officials.

15. Probationary period for commune-level officials.

a) Specifically, probation periods for commune-level officials are as follows: 12 months for those recruited with a university degree or higher; 6 months for those with a degree below university level. No probation policies apply to the position of Chief Commander of the Commune-level Military Command.

b) Recruited individuals holding the title of commune-level official who complete the probation policies as stipulated here will be recommended by the Chairman of the Commune People's Committee to the Chairman of the District People's Committee to recognize completion of the probation period and assign salaries to the recruited officials.

Thus, according to the above regulations, the individuals eligible for an additional 2.5 points when participating in commune-level official recruitment include:

- Young intellectual volunteers participating in rural and mountainous area development;

- Non-specialized workers at the commune level for 24 months or more who have been evaluated as completing the task or higher.

Who are commune-level officials in Vietnam?

Based on Decree 33/2023/ND-CP on commune-level officials and non-specialized workers at the commune, village, and residential group levels issued by the Government of Vietnam on June 10, 2023:

Positions and titles for commune-level officials are prescribed in Article 5 of Decree 33/2023/ND-CP as follows:

Positions and titles

1. Commune-level officials specified in Clause 1, Article 2 of this Decree include the following positions:

a) Secretary and Deputy Secretary of the Communist Party Committee;

b) Chairman and Vice Chairman of the People's Council;

c) Chairman and Vice Chairman of the People’s Committee;

d) Chairman of the Vietnam Fatherland Front Committee;

dd) Secretary of the Ho Chi Minh Communist Youth Union;

e) Chairwoman of the Vietnam Women's Union;

g) Chairman of the Vietnam Farmers' Union (applicable to communes, wards, commune-level towns with agricultural, forestry, fishery, and salt-making activities and with the Vietnam Farmers' Union organization);

h) Chairman of the Vietnam Veterans' Association.

2. Commune-level officials specified in Clause 1, Article 2 include the following titles:

a) Chief Commander of the Military Command;

b) Office - Statistics;

c) Land - Construction - Urban and Environment (for wards, commune-level towns) or Land - Agriculture - Construction and Environment (for communes);

d) Finance - Accounting;

dd) Justice - Civil status;

e) Culture - Society.

Thus, according to the above regulations, commune-level officials include:

Commune-level officials

 - Secretary and Deputy Secretary of the Communist Party Committee;

- Chairman and Vice Chairman of the People's Council;

- Chairman and Vice Chairman of the People’s Committee;

- Chairman of the Vietnam Fatherland Front Committee;

- Secretary of the Ho Chi Minh Communist Youth Union;

- Chairwoman of the Vietnam Women's Union;

- Chairman of the Vietnam Farmers' Union (applicable to communes, wards, commune-level towns with agricultural, forestry, fishery, and salt-making activities and with the Vietnam Farmers' Union organization);

- Chairman of the Vietnam Veterans' Association.

Commune-level officials

Including the following titles:

- Chief Commander of the Military Command;

- Office - Statistics;

- Land - Construction - Urban and Environment (for wards, commune-level towns) or Land - Agriculture - Construction and Environment (for communes);

- Finance - Accounting;

- Justice - Civil status;

- Culture - Society.

Compared to the current regulations, the new regulations have removed "Chief of Commune Police" from the titles of commune-level officials.

Who are recruited to work as commune-level officials in Vietnam?

Individuals accepted to work as commune-level officials as regulated in Article 14 of Decree 33/2023/ND-CP include:

- Officials working at public service providers.

- Individuals receiving salaries in the People's Armed Forces, individuals working in cipher organizations but not officials.

- Individuals who have resigned from their positions as commune-level officials (except those dismissed).

- Individuals who were previously officials (including commune-level officials) and then transferred to non-official positions at other agencies and organizations by competent authorities.

Article 15 of Decree 33/2023/ND-CP stipulates that the recruitment of commune-level officials and the acceptance of individuals into commune-level official positions fall under the jurisdiction of the Chairman of the District People's Committee.
