What are the duties and powers of the Department of Justice regarding the notarization practice internship?
According to Article 28 Circular 08/2023/TT-BTP, regarding the notarization practice internship, the Department of Justice of provinces and centrally-run cities has the following duties and powers:
- Designate notarization practice organizations that meet the conditions to accept interns in the locality; consider the refusal to accept interns by the notarization practice organizations, and the refusal to guide interns by notaries as per regulations.
- Register internships, delete internship registrations, change internship locations, suspend internships, terminate internships, and acknowledge the completion of internships as per regulations.
- Compile and publish the list of notarization practice organizations that meet the conditions to accept interns in the locality on the Department of Justice's electronic information portal and regularly review and update this list.
- Establish a Logbook for Notarization Practice Internships of the Department of Justice; promptly update information on internship registrations, changes of guiding notaries, changes of internship locations, suspension of internships, termination of internships, and acknowledgment of internship completion in the Logbook and the Ministry of Justice's notarization practice management software.
- Monitor and manage the acceptance of interns, the guidance of interns, and internships as per this Circular and related legal provisions.
- Inspect, audit, handle violations, and resolve complaints and denunciations regarding notarization practice internships as per legal provisions.
- Perform other duties and powers as prescribed by the Notary Law, this Circular, and other relevant legal documents.
Which agency is responsible for handling violations in notarization practice internships?
Based on Article 30 Circular 08/2023/TT-BTP governing the handling of violations regarding notarization practice internships:
Handling violations regarding notarization practice internships
1. Interns who violate the provisions of this Circular, have been reminded and required to correct their conduct in writing at least 03 times by the notarization practice organization accepting them, and still continue to violate, the notarization practice organization will propose the Department of Justice to consider terminating the internship. If the notarization practice organization intentionally conceals violations and fails to report to the Department of Justice, the Department of Justice will inspect, audit, and handle as per legal provisions.
2. Notaries who unjustifiably refuse to guide interns, violate the provisions of this Circular, and other related legal documents will, depending on the nature and severity of the violation, be subject to one of the forms of handling as per legal provisions.
3. Notarization practice organizations listed as eligible to accept interns that refuse to take interns without a valid reason, appoint unqualified notaries to guide interns, or violate other provisions of this Circular and related legal documents will, depending on the nature and severity of the violation, be subject to handling as per legal provisions.
Given the above regulations, the handling of violations in the notarization practice internship will be the responsibility of the Department of Justice and will be implemented as follows:
- Interns violating the provisions of Circular 08/2023/TT-BTP who have been reminded and required to correct their conduct in writing at least 03 times by the notarization practice organization and still continue to violate, the Department of Justice will consider terminating their internship upon the proposal of the notarization practice organization.
- The Department of Justice will inspect, audit, and handle as per legal provisions in cases where the notarization practice organization intentionally conceals violations and fails to report.
Circular 08/2023/TT-BTP will be effective from November 20, 2023.
