Pursuant to the provisions of Article 57 of the 2009 Law on Telecommunications in Vietnam stipulating as follows:
Planning of telecommunications works in Vietnam
1. Public telecommunications works are given priority in using spaces, ground surface, underground spaces, river bed and sea bed. Public telecommunications service provision spots may be located first of all at railway stations, car terminals, seaports, airports, border gates and other public places to satisfy the needs of telecommunications service users.
2. Planning on construction of traffic works, urban centers, residential areas, industrial parks, economic zones and hi-tech parks must cover planning on inactive telecommunications technical infrastructure in order to ensure the uniformity and synchronism in construction investment and convenience for establishment of telecommunications infrastructure and provision and use of telecommunications services.
3. Local planning on inactive telecommuni¬cations technical infrastructure must be in line with the national telecommunications development plan and local socio-economic development plans and constitute a mandatory content of regional construction planning, urban construction planning and rural residential area construction planning under the Law on Construction and the Law on Urban Planning.
According to the above regulations, public telecommunications works are given priority in using spaces, ground surface, underground spaces, river bed and sea bed.

What is included in the planning of passive telecommunication technical infrastructure in Vietnam?
Pursuant to the provisions of Clause 1, Article 40 of Decree No. 25/2011/ND-CP, the planning of passive telecommunication technical infrastructure includes:
- Planning construction of important telecommunications works relating to national security, points for supply of public-utility telecommunication services of telecommunication enterprises, which specify the size, scope, location for the construction and installation of this work;
- Planning peripheral network which defines the requirements, conditions for the installation location for antenna pole, line and direction for building the suspension pole, sewer, tank, cable ducts
What are the cases in which a license to construct a passive telecommunication technical infrastructure is not required?
Pursuant to the provisions of Clause 1, Article 41 of Decree No. 25/2011/ND-CP, before starting the construction of passive telecommunication technical infrastructure, investors must have a building permit, except the following cases:
- Line of column used for hanging telecommunication cables, system of antenna poles that are not in urban areas and are consistent with the approved planning of telecommunication technical infrastructure of the enterprise and the approved project of investment for construction;
- Antenna pole that is not bulky in accordance with the Ministry of Information and Communications and is installed in and on top of buildings in urban areas without changing the architecture, structural strength and safety of the building, surrounding landscape and environment and is in line with the approved planning of telecommunication technical infrastructure of the enterprise;
- A point for supplying the public-utility telecommunication services without staff that is included in the planning of approved passive telecommunication technical infrastructure of enterprise and have the approved sample design;
- A passive telecommunication technical infrastructure work that was installed to provide telecommunication services in emergencies;
- Other passive telecommunication technical infrastructure works as specified by the Ministry of Information and Communications.
What are the regulations on designing and construction of telecommunications works in Vietnam?
Pursuant to the provisions of Article 59 of the 2009 Law on Telecommunications in Vietnam, the designing and construction of telecommunications works are as follows:
- Traffic works, electricity poles and transmission lines, water supply and drainage pipelines and other technical infrastructure works must be designed and constructed to ensure the installation and protection of telecommunications transmission lines and works.
- The construction of telecommunications works must be in line with the planning on inactive telecommunications technical infrastructure and compliant with this Law and other relevant laws. Inactive telecommunications technical infrastructure constitutes a mandatory content of basic designs of systems of traffic, energy supply, public lighting, water supply and drainage technical infrastructure works and other technical infrastructure works.
- Organizations and individuals that construct telecommunications technical infrastructure in association with investment in and installation of telecommunications equipment and cable lines shall notify such to local telecommunications management agencies.
