Definitions

For the purposes of this Decree, the following terms shall have the meanings indicated below:

1. Fireworks are products that contain fireworks compounds, which, upon the impact of mechanical, thermal, chemical, or electrical stimuli, cause rapid and strong chemical reactions, releasing gases, and creating sound, light, and color effects in the space, causing explosions or not. Fireworks include: Explosive fireworks and non-explosive fireworks.

a) Explosive fireworks are products manufactured by hand or industrially, which, upon the impact of mechanical, thermal, chemical, or electrical stimuli, generate sounds, whistles, explosions, and color effects in the space;

Explosive fireworks generating whistles, explosions, and color effects in the space are called bursting fireworks;

Low-altitude bursting fireworks are fireworks with a diameter not exceeding 90 mm or a firing range not exceeding 120 meters. High-altitude bursting fireworks are fireworks with a diameter of over 90 mm or a firing range of over 120 meters;

b) Non-explosive fireworks are products manufactured by hand or industrially, which, upon the impact of mechanical, thermal, chemical, or electrical stimuli, create sound, light, and color effects in the space, without causing explosions.

Where Are the High-Altitude Fireworks Display Locations for the 2023 Lunar New Year?

Article 11 of Decree 137/2020/ND-CP stipulates cases for organizing explosive fireworks displays as follows:

Cases for Organizing Explosive Fireworks Displays

1. Lunar New Year

a) The centrally run cities and Thua Thien Hue province are allowed to set off high- and low-altitude explosive fireworks, with a duration not exceeding 15 minutes; the remaining provinces are allowed to set off low-altitude explosive fireworks, with a duration not exceeding 15 minutes;

b) The fireworks display time is at the moment of the Lunar New Year's Eve.

2. Hung Kings' Commemoration Day

a) Phu Tho province is allowed to set off low-altitude explosive fireworks, with a duration not exceeding 15 minutes, at the Hung Temple area;

b) The fireworks display time is at 9:00 PM on the 9th of the lunar March.

3. National Day

a) The centrally run cities and Thua Thien Hue province are allowed to set off high- and low-altitude explosive fireworks, with a duration not exceeding 15 minutes; the remaining provinces are allowed to set off low-altitude explosive fireworks, with a duration not exceeding 15 minutes;

b) The fireworks display time is at 9:00 PM on September 2.

4. Dien Bien Phu Victory Day

a) Dien Bien province is allowed to set off low-altitude explosive fireworks, with a duration not exceeding 15 minutes, at Dien Bien Phu city;

b) The fireworks display time is at 9:00 PM on May 7.

5. Victory Day (April 30)

a) The capital city of Hanoi and Ho Chi Minh City are allowed to set off high- and low-altitude explosive fireworks, with a duration not exceeding 15 minutes;

b) The fireworks display time is at 9:00 PM on April 30.

6. Anniversaries of liberation and establishment of centrally run provinces and cities

a) The centrally run cities and Thua Thien Hue province are allowed to set off high- and low-altitude explosive fireworks, with a duration not exceeding 15 minutes; the remaining provinces are allowed to set off low-altitude explosive fireworks, with a duration not exceeding 15 minutes;

b) The fireworks display time is at 9:00 PM on the anniversary of liberation and establishment of centrally run provinces and cities.

7. National and international cultural, tourism, and sports events.

8. Other cases decided by the Prime Minister.

During the 2023 Lunar New Year, the centrally run cities (including Hanoi, Ho Chi Minh City, Hai Phong, Da Nang, Can Tho) and Thua Thien Hue province will be allowed to organize high- and low-altitude explosive fireworks displays with a duration not exceeding 15 minutes. The remaining provinces are only allowed to set off low-altitude fireworks.

What Is the Authority for Organizing Fireworks Displays for the 2023 Lunar New Year?

Article 12 of Decree 137/2020/ND-CP stipulates the authority and procedures for permitting explosive fireworks displays as follows:

Authority and Procedures for Permitting Explosive Fireworks Displays

1. The cases for organizing explosive fireworks displays stipulated in Clauses 1, 2, 3, 4, 5, and 6 of Article 11 of this Decree shall be decided by the People's Committees of provinces and centrally run cities based on the actual situation of the localities and in cooperation with the Ministry of Culture, Sports and Tourism to implement according to regulations.

2. The cases for organizing explosive fireworks displays stipulated in Clauses 7 and 8 of Article 11 of this Decree and cases of changing the firing range and duration of explosive fireworks displays shall be decided by the Prime Minister.

3. Provinces and centrally run cities wishing to organize explosive fireworks displays as stipulated in Clauses 7 and 8 of Article 11 of this Decree or wanting to change the firing range and duration of explosive fireworks displays must propose in writing to the Ministry of Culture, Sports and Tourism at least 30 days in advance. The written proposal must clearly state the number of fireworks, firing range, number of firing points, time, duration, and the expected location of the fireworks display.

Within 5 working days from the receipt of the written proposal, the Ministry of Culture, Sports and Tourism shall report to the Prime Minister for consideration and decision.

Thus, in the case of organizing fireworks displays for the 2023 Lunar New Year, the People's Committees of provinces and centrally run cities will cooperate with the Ministry of Culture, Sports and Tourism to implement them.
