Accordingly, the 1st to 6th of the 2024 Tet holiday falls on the following days:
- The 1st day of Tet: on Saturday, February 10, 2024 of the solar calendar;
- The 2nd day of Tet: on Sunday, February 11, 2024 of the solar calendar;
- The 3rd day of Tet: on Monday, February 12, 2024 of the solar calendar;
- The 4th day of Tet: on Tuesday, February 13, 2024 of the solar calendar;
- The 5th day of Tet: on Wednesday, February 14, 2024 of the solar calendar.
- The 6th day of Tet: on Thursday, February 15, 2024 of the solar calendar.

Pursuant to Announcement 5015/TB-LDTBXH of 2023, Officials, public employees and employees working at administrative agencies, political organizations or socio-political organizations (hereinafter referred to as “officials and public employees”) are entitled to have the Lunar New Year holiday in 2024 from:
Thursday, February 08, 2024 of the solar calendar (i.e. December 29, 2023 of the lunar calendar) to the end of Wednesday, February 14, 2024 of the solar calendar (i.e. January 05, 2024 of the lunar calendar)
When will employees be entitled to have the Tet holiday in Vietnam in 2024?
Article 112 of the 2019 Labor Code stipulates holidays and New Year holidays as follows:
Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
...
b) Lunar New Year Holidays: 05 days;
Accordingly, employees will be entitled to Tet holiday in 2024 based on the provisions of the Labor Code and 03 options that the employer decides to choose based on Announcement 5015/TB-LDTBXH of 2023 in 2023 as follows:
(1) 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar
(2) 02 ending days of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar
(3) 03 ending days of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar
Thus, based on the above plan for Tet holiday in 2024, employees will start taking Lunar New Year leave in 2024 depending on the employer's decision, specifically:
(1) From Friday, February 9, 2024 (ie December 30 of the lunar calendar)
(2) From Thursday, February 8, 2024 (ie December 29of the lunar calendar)
(3) From Wednesday, February 7, 2024 (ie December 28 of the lunar calendar).
Will employees be entitled to an additional leave after the Tet holiday in Vietnam?
Pursuant to the provisions of Article 113 of the 2019 Labor Code:
Annual leave
1. Any employee who has been working for an employer for 12 months is entitled to fully-paid annual leave, which is stipulated in his/her employment contract as follows:
a) 12 working days for employees who work in normal working conditions;
b) 14 working days for employees that are minors, the disabled, employees who do laborious, toxic or dangerous works;
c) 16 working days for employees who do highly laborious, toxic or dangerous works.
2. An employee who has been working for an employer for less than 12 months will have a number of paid leave days proportional to the number of working months.

Article 115 of the 2019 Labor Code also stipulates:
Personal leave, unpaid leave
1. An employee is entitled to take a fully paid personal leave in the following circumstances, as long as it is notified to the employer in advance:
a) Marriage: 03 days;
b) Marriage of his/her biological child or adopted child: 01 day;
c) Death of his/her biological or adoptive parent; death of his/her spouse’s biological or adoptive parent; death of spouse, biological or adopted child: 03 days.
2. An employee is entitled to take 01 day of unpaid leave and must inform the employer in the case of the death of his/her grandparent or biological sibling; marriage of his/her parent or natural sibling.
3. The employee may negotiate with his/her employer on taking unpaid leave other than the leave stipulated in Clause 1 and Clause 2 of this Article.
Thus, to determine whether an additional leave after the Tet holiday was paid, it needs to depend on the specific case:
+ If the employee takes leave and it is determined as annual leave, the employee will receive full salary according to the labor contract.
+ If the employee takes leave for the reasons in Clause 1, Article 115 of the 2019 Labor Code and has notified the employer, the employee will still receive full salary.
+ If the employee takes leave and is determined to be on unpaid leave according to the agreement, the employee will not be entitled to salary.
