Which Subjects are Entitled to Monthly Allowances for People's Police Participating in Anti-US Resistance Who Have Been Demobilized?
On August 25, 2023, the Ministry of Public Security issued Circular 41/2023/TT-BCA stipulating the implementation of allowing policies for officers and soldiers of the People's Police who participated in the anti-US resistance with less than 20 years of service in the People's Police, and who have resigned and returned to their localities.
Based on Article 2 of Circular 41/2023/TT-BCA stipulating the subjects entitled to allowances:
Subjects of Application
1. This Circular applies to:
a) Officers and soldiers specified in Article 2 and Clause 1, Article 8 of Decision No. 53/2010/QD-TTg dated August 20, 2010, of the Prime Minister of the Government of Vietnam, stipulating policies for officers and soldiers who participated in the anti-US resistance with less than 20 years of service in the People's Police, and who have resigned and returned to their localities (hereinafter referred to as Decision No. 53/2010/QD-TTg).
b) Units under the Ministry of Public Security, provincial-level and centrally-run city police (hereinafter referred to as police units and localities).
c) Agencies, organizations, and individuals related to the implementation of policies for officers and soldiers as stipulated in this Circular.
2. This Circular does not apply to:
a) Cases specified in Article 3 of Decision No. 53/2010/QD-TTg.
b) Officers and soldiers violating discipline and being forced to resign, dismissed, discharged, removed, defrocked, or expelled.
c) Police workers (police civil servants).
Thus, the subjects entitled to monthly allowances for the People's Police who participated in the anti-US resistance and have been demobilized are the following officers and soldiers:
- Officers and soldiers of the People's Police who participated in the anti-US resistance, joined the People's Police before April 30, 1975, with less than 20 years of service in the People's Police, have resigned and returned to their localities, and currently do not enjoy a pension, labor loss policy, or monthly disease policy.
- Officers and soldiers of the People's Police who participated in the anti-US resistance, joined the People's Police before April 30, 1975, with less than 20 years of service in the People's Police, have resigned and returned to their localities, and then worked in communes, wards, or commune-level towns.
- Officers and soldiers of the People's Police who have been demobilized or resigned to their localities with time spent in the People's Army before April 30, 1975.

Based on Article 4 of Circular 41/2023/TT-BCA stipulating the monthly allowance policy as follows:
Monthly Allowance Policy
1. Officers and soldiers specified in Point a, Clause 1, Article 2 of this Circular, who fall into the following cases, are entitled to monthly allowance policies:
a) Having a service time calculated for allowance policy from 15 years to less than 20 years;
b) Having a service time calculated for allowance policy from 15 years to less than 20 years, have resigned and returned to their localities, then worked in communes, wards, or commune-level towns receiving salaries from the state budget with participation in mandatory social insurance but not qualifying or choosing not to continue paying voluntary social insurance to qualify for a monthly pension as per the social insurance law.
Thus, the People's Police participating in the anti-US resistance are entitled to monthly allowance policies if they fall into the following cases:
- The People's Police participating in the anti-US resistance with service time calculated for allowance policies from 15 years to less than 20 years;
- The People's Police participating in the anti-US resistance with service time calculated for allowance policies from 15 years to less than 20 years, have resigned and returned to their localities, then worked in communes, wards, or commune-level towns receiving salaries from the state budget with participation in mandatory social insurance but not qualifying or choosing not to continue paying voluntary social insurance to qualify for a monthly pension as per the social insurance law.
What is the Amount of Monthly Allowance for the People's Police Participating in the Anti-US Resistance from October 10, 2023?
Based on Clause 2, Article 4 of Circular 41/2023/TT-BCA, the monthly allowance policy for the People's Police participating in the anti-US resistance is calculated based on the actual service time calculated for allowance policy. Specifically:
- From 15 years to less than 16 years, the allowance is 813,614 VND/person/month;
- From 16 years to less than 17 years, the allowance is 854,295 VND/person/month;
- From 17 years to less than 18 years, the allowance is 894,975 VND/person/month;
- From 18 years to less than 19 years, the allowance is 935,656 VND/person/month;
- From 19 years to less than 20 years, the allowance is 976,337 VND/person/month.
