When is Vietnam Border Guard authorized to inspect and control vehicles in border areas and checkpoints?
Pursuant to the Law on Vietnam Border Guard 2020,
Pursuant to Article 15 the Law on Vietnam Border Guard 2020, it stipulates the authority of the Vietnam Border Guard as follows:
Authority of Vietnam Border Guard
1. Arrange and utilize forces, vehicles, and technical equipment to fulfill their duties; apply forms and measures to manage and protect the national border as regulated in Article 19 and Article 20 of this Law.
Patrol, inspect, control, manage, and protect the national border, border landmarks, boundary markers, border signs, border constructions, checkpoints; issue, amend, supplement, revoke visas and other documents in the field of managing and protecting the national border; inspect and control vehicles when there are signs of law violations, handle vehicles that violate the law in the border areas and checkpoints according to the provisions of the law.
2. Combat, prevent, investigate, and handle law violations in the border areas and checkpoints according to the provisions of the law.
3. Restrict or temporarily suspend activities in the border belt, border areas, border crossings, and open passages as regulated in Article 11 of this Law.
4. Use weapons, explosives, and supporting tools as regulated in Article 17 of this Law.
5. Mobilize civilians, ships, vehicles, and technical equipment as regulated in Article 18 of this Law.
6. Directly pursue, capture individuals and vehicles that violate the law from the border to the inland; coordinate with search and capture forces to apprehend individuals who commit law violations and flee into the inland; pursue, capture individuals and vehicles that violate the law and escape from Vietnam's internal waters and territorial seas beyond Vietnam's territorial waters as regulated by the laws of Vietnam and international conventions of which the Socialist Republic of Vietnam is a member.
7. Cooperate and coordinate with the functional forces of countries sharing a border, other countries, and international organizations in the management, protection of the national border, checkpoints, crime prevention, and law enforcement as regulated by the laws of Vietnam and international conventions of which the Socialist Republic of Vietnam is a member.
Therefore, according to the above provisions, Vietnam Border Guard is authorized to inspect and control vehicles when there are signs of law violations, and handle vehicles that violate the law in the border areas and checkpoints according to the provisions of the law.

Vietnam: What does border area on land mean under the Law on National Border 2003?
Pursuant to the Law on National Border 2003 .
Pursuant to Article 6 of the Law on National Border 2003, there are regulations on border areas as follows:
Article 6
Border area includes:
1. Border area on land includes communes and townlets whose partial administrative division meets the land border;
2. Border area at sea is determined from the national border at sea to the inclusive administrative division of communes, wards and townlets adjoining the sea, islands and archipelagoes;
3. Border area in the air includes the space of 10 kilometers along the national border stretching inwards.
Thus, according to the above regulations, border area on land includes communes and townlets whose partial administrative division meets the land border.
Specifically, pursuant to Article 8 of Decree 140/2004/ND-CP: The scope of a land border region is calculated from the national land border to the administrative boundaries of communes, wards, district townships which have part of their administrative boundaries overlap the national land border..
What are the tasks of the Vietnam Border Guard?
Pursuant to the provisions in Article 14 of the Law on Vietnam Border Guard 2020, the tasks of the Vietnam Border Guard are defined as follows:
Tasks of the Vietnam Border Guard
1. Collect information, analyze, evaluate, and forecast the situation to carry out tasks and propose policies and laws on border defense to the Ministry of National Defense, the Party, and the State for issuance and guidance.
2. Advise the Ministry of National Defense on the management and protection of the national border, maintaining security, order, and social safety in the border areas, checkpoints, and building the Vietnam Border Guard force.
3. Manage and protect the national border, the system of border landmarks, border signs, border constructions, checkpoints; organize inspections to ensure compliance with border defense laws.
4. Maintain security, order, and social safety, prevent, detect, and combat the activities of hostile forces, crime, and violations of the law, protect the lawful rights and interests of agencies, organizations, and individuals in the border areas and checkpoints in accordance with the law.
5. Control entry and exit at checkpoints managed and controlled by the Ministry of National Defense and regulate border crossings in accordance with the law.
6. Conduct international cooperation on border defense, border diplomacy; resolve border and checkpoint-related issues in accordance with the law.
7. Disseminate, popularize, and educate the law, mobilize the people to implement the Party's guidelines, the policies, and laws of the State.
8. Be ready to fight and combat armed conflicts, invasive wars in the border areas.
9. Provide advice and serve as the core in building the people's border defense system, the people's border defense posture in the border areas; participate in the construction of provincial-level, district-level border defense zones, civil defense.
10. Receive and utilize civilian personnel and resources to carry out tasks in accordance with the law.
11. Participate in building the grassroots political system, stabilizing population, constructing infrastructure, developing the socio-economy, and implementing ethnic and religious policies in the border areas, closely linked to the construction and consolidation of national defense and security.
12. Participate in prevention, control, response, and recovery from incidents, natural disasters, climate change, epidemics; search and rescue operations in the border areas.
Therefore, the Vietnam Border Guard has these 12 tasks as mentioned above.
