When does the National Assembly hold an extraordinary session?
Pursuant to Article 90 of the 2014 Law on Organization of the National Assembly of Vietnam on the National Assembly sessions as follows:
- The National Assembly shall hold its sessions in public.
The National Assembly may, when necessary and at the proposal of the President, Standing Committee of the National Assembly, Prime Minister or by at least one-third of the total number of National Assembly deputies, decide to conduct a closed session.
- The National Assembly shall hold two regular sessions a year.
The National Assembly shall hold an extraordinary session when so requested by the President, Standing Committee of the National Assembly, Prime Minister or at least one-third of the total number of National Assembly deputies.
- The National Assembly shall discuss and decide on matters falling within its tasks and powers at its sessions according to the procedures provided in the Rules on National Assembly sessions and other related laws.
In addition, based on Clauses 2 and 3, Article 1 of Resolution No. 71/2022/QH15 also stipulating the National Assembly session as follows:
National Assembly session
1. The National Assembly session is the main form of operation of the National Assembly. At the session, the National Assembly discusses and decides on issues within its duties and powers in accordance with law.
Sessions of the National Assembly may be held continuously or in two or more installments.
2. The National Assembly holds regular meetings twice a year.
At the request of the President, Standing Committee of the National Assembly, the Prime Minister or at least one-third of the total number of National Assembly deputies, the National Assembly holds an extraordinary session to discuss and decide on issues within its duties and powers, except for contents periodically submitted to the National Assembly as prescribed by law.
3. The National Assembly Standing Committee shall guide the organization of the extraordinary meeting.
Thus, at the request of the President, Standing Committee of the National Assembly, the Prime Minister or at least one-third of the total number of National Assembly deputies, the National Assembly holds an extraordinary session.

How long does it take to convene an extraordinary session of the National Assembly of Vietnam before the session opens?
Pursuant to Article 92 of the 2014 Law on Organization of the National Assembly of Vietnam stipulating as follows:
Convening National Assembly sessions
1. The Standing Committee of the National Assembly shall decide to convene a regular or an extraordinary National Assembly session no later than 30 days or 7 days respectively before the session opens.
2. The first session of a newly elected National Assembly shall be convened within sixty days from the date of election of National Assembly deputies.
3. The decision to convene a session together with its tentative agenda shall be sent to National Assembly deputies.
Thus, the Standing Committee of the National Assembly shall decide to convene an extraordinary National Assembly session no later than 07 days before the session opens.
Are National Assembly deputies obligated to attend all sessions of the National Assembly of Vietnam?
Pursuant to Article 3 of the Rules on National Assembly sessions, promulgated together with Resolution No. 71/2022/QH15 stipulating as follows:
Responsibilities of National Assembly deputies
1. National Assembly deputies are responsible for fully participating in National Assembly sessions and sessions, focusing on research, participating in discussions, giving opinions on contents of National Assembly sessions and voting on issues within duties and powers of the National Assembly.
2. In case it is impossible to attend a session of the National Assembly or a meeting according to the meeting agenda approved by the National Assembly, a National Assembly delegate has the following responsibilities:
a) Report to the Head of the National Assembly Delegation to notify the General Secretary of the National Assembly to summarize and report to the President of the National Assembly if he is absent for 02 working days or less during the whole session of the National Assembly;
b) Report in writing, clearly stating the reason, to the Head of the National Assembly delegation to notify the Secretary-General of the National Assembly to summarize and report to the President of the National Assembly for decision if he cannot attend the National Assembly session or is absent for a total of more than 02 working days in the whole session of the National Assembly.
In case of absence due to health reasons or force majeure reasons, the National Assembly deputies shall report to the Head of the National Assembly Delegation to notify the General Secretary of the National Assembly to summarize and report to the President of the National Assembly;
c) In case of absence to perform tasks of a National Assembly session in accordance with laws and resolutions of the National Assembly, the National Assembly delegate shall report to the Head of the National Assembly delegation and at the same time notify the Secretary General of the National Assembly. Assembly reports to the President of the National Assembly.
The list of National Assembly deputies unable to attend the National Assembly session or absent from the meeting as prescribed at Points a and b of this Clause shall be recorded in the meeting minutes and the National Assembly session minutes.
3. National Assembly deputies giving interviews and providing information about the National Assembly session must be accurate and objective; does not disclose information and documents within the scope of state secrets, contents of closed sessions of the National Assembly.
4. National Assembly deputies are responsible for using and preserving documents of the National Assembly session in accordance with law; return documents to be recovered upon request; use and preserve the National Assembly deputies badges, National Assembly deputies cards, and equipped equipment according to regulations.
Thus, National Assembly deputies are responsible for fully participating in National Assembly sessions and sessions, focusing on research, participating in discussions, giving opinions on contents of National Assembly sessions and voting on issues within duties and powers of the National Assembly.
In case it is not possible to attend the meeting, the National Assembly session must make a notice according to the provisions of Clause 2, Article 3 of the Rules on National Assembly sessions promulgated together with Resolution No. 71/2022/QH15.
