When are vehicles subject to the temporary registration? What are the order and procedures for granting temporary vehicle registration certificates and license plates?
What are the regulations on the vehicle registration authority?
According to Article 3 of Circular 58/2020/TT-BCA of Vietnam and Clause 1 Article 3 of Circular 15/2022/TT-BCA of Vietnam stipulating vehicle registration authority (also known as the competent vehicle registry) as follows:
- The competent vehicle registry shall manage and keep records as prescribed, information about vehicles is consistently managed on the registration database of the Department of Traffic Police.
- The competent vehicle registry must have direction diagrams and citizen reception schedule, and be located in a place convenient for receiving and processing applications and procedures for vehicle registration, have seats, a parking lot, mailbox, desk name plates for officers in charge of vehicle registration and publicly post up regulations governing procedures for vehicle registration, vehicle registration fees, violations against regulations on vehicle registration and issuance of license plates and respective punishment.
- Department of Traffic Police shall register and issue the license plate for vehicles of Ministry of Public Security, and automobiles of diplomatic missions, consular offices and representative offices of international organizations and foreign nationals working for these ones; automobiles owned by agencies and organizations as stipulated at the Appendix No.01 of this Circular.
- The Traffic Police Divisions, the Road and Rail Traffic Police Divisions and the Road Traffic Police Divisions controlled by the Police Departments of provinces and centrally-affiliated cities (hereinafter referred to as Traffic Police Division) shall grant registrations and number plates to car, tractors, trailers, semi-trailers and others having the same structures thereof under the ownership of foreign agencies, organizations and individuals; of projects and economic organizations in partnership with foreign entities that are locally operated, agencies, organizations, enterprises, military enterprises, individuals whose offices or permanent addresses are in districts and centrally-affiliated cities or provincially-affiliated cities where Traffic Police Divisions’ offices are located (except types of vehicles under the ownership of agencies, organizations and individuals specified in clause 3 of Article 3 herein).
- Police Divisions of districts, towns, provincially or centrally-affiliated cities (hereinafter referred to as district Police) shall grant registration application and number plates to the following vehicles (except types of vehicles of agencies, organizations, enterprises, military enterprises and individuals specified in clause 3, 4 and 6 of Article 3 herein):
+ Cars, tractors, trailers, semi-trailers and other similar vehicles under the ownership of domestic agencies, organizations, enterprises, military enterprises or individuals whose offices or permanent residence addresses are located under their jurisdiction.
+ Cars, motorbikes (including electric bikes) and other similar vehicles under the ownership of domestic agencies, organizations, enterprises, military enterprises or individuals whose offices or permanent residence addresses are located under their jurisdiction; foreign agencies, organizations, individuals, projects or economic organizations in partnership with foreign entities that fall within their remit.
+ Conditions, authority and duration of completion of delegation of authority to grant vehicle registration and number plates of district-level Police Divisions shall be subject to clause 6 of Article 26 herein.
- Police of communes, wards or towns (hereinafter referred to commune-level Police) grants vehicle registration and number plates to motorbikes (including electric bikes) under the ownership of domestic agencies, organizations, enterprises, military enterprises or individuals whose offices or permanent residence addresses are located under their jurisdiction; foreign agencies, organizations, individuals, projects or economic organizations in partnership with foreign entities that fall within their remit; withdraws certificates of the vehicle registration or number plate with respect to the vehicles whose useful life expires, vehicles damaged to the extent of being out of order of agencies, organizations or individuals whose offices or permanent residence addresses are located within their jurisdiction.
Conditions and authority to grant vehicle registration and number plates of commune-level Police Divisions shall be subject to clause 6 of Article 26 herein.
Temporary vehicle registration
When are vehicles subject to the temporary registration?
According to Article 3 of Circular 58/2020/TT-BCA of Vietnam, vehicles are subject to the temporary registration in the following cases:
- Vehicles which have not been registered or issued with official license plates wish to join traffic;
- Vehicles registered abroad which have been permitted by the competent authorities to enter Vietnam for tourism, conferences, trade fairs, exhibition, and sports;
- Vehicles used for conferences held by the Communist Party, the State, the Government;
- Vehicles applying for revocation of certificate of vehicle registration and license plate to be re-exported to home country or transfer in Vietnam and vehicles subject to a decision on transfer, sale, or gifting.
What are the documentation and procedures of temporary vehicle registration?
According to Article 13 of Circular 58/2020/TT-BCA of Vietnam and Clause 3 Article 3 of Circular 15/2022/TT-BCA of Vietnam on the documentation of temporary vehicle registration:
“Article 13. The documentation of temporary vehicle registration
1. A vehicle, manufactured and assembled in Vietnam, must complete the following documents:
a) The declaration of vehicle registration (form 01);
b) The copy of sales invoice as prescribed or warehouse discharge note.
2. Imported vehicles; those that are temporarily imported and re-exported within an expiration date:
a) The declaration of vehicle registration (form 01);
b) The copy of declaration of import and export goods or a detailed declaration of imported vehicle. If a vehicle completes the procedure for importation, the application for the registration and issuance of temporary license plate must include certain documents as stipulated at Clause 1 Article 8 of this Circular.
3. Vehicles permitted by competent authorities to enter Vietnam for tourism, conferences, trade fairs, exhibition, and sports; foreign vehicles travelling in Vietnam and vehicles used for conferences held by the Communist Party, the State, or the Government: The copy of certificate of vehicle registration or list of vehicles applied for registration approved by the competent authority.
4. As for automobiles, owned by foreigners and registered in foreign countries, and built with right-hand drive, or “canavan” left-hand drive that are allowed to run on the roads as per the law, the application for its legal operation on the roads shall include:
a) The declaration of vehicle registration (form 01);
b) A document which allows the automobile to run on the roads in Vietnam made by the competent authority.
5. Procedures and processes for granting vehicle registration certificates or number plates for temporary use
a) Granting vehicle registration certificates or number plates for temporary use on the Public Service Portal of the Ministry of Public Security or the National Service Portal: Vehicle owners sign in the public service portal to enter information about the vehicle or vehicle owner in the electronic Application form for vehicle registration (form No. 01B/58) (specifying the number of the electronic application form for vehicle registration, the number of certificate of pre-dispatch quality inspection for verifying vehicle origin) and send attached documents (proof of transfer of vehicle ownership, letter of authorization allowing the declarant submitting application to apply for vehicle registration for temporary use); pay the fee for vehicle registration for temporary use; receive results of authentication of temporary vehicle registration from registration agencies on the public service portal and print the certificate of vehicle registration and number plate for temporary use online (form No. 05A/58) with respect to imported vehicles or domestically-manufactured or assembled vehicles running from warehouses, storage facilities, ports, factories or vehicle agencies to registration locations or to other agencies, warehouses or storage facilities; vehicles moved to other localities; vehicles re-exported to their home countries or assigned in Vietnam.
b) Granting vehicle registration certificates or number plates for temporary use in case of vehicle owner’s application for registration with registration agencies in person:
Vehicle owners shall be required to submit the documents specified in Article 13 herein (bringing vehicles to the inspection location is not required).
The officer tasked with vehicle registration finalizes required dossiers and immediately grants vehicle registration certificates or number plates for temporary use.”
Circular 15/2022/TT-BCA of Vietnam takes effect on May 21, 2022.
