What are labor mediator standards in Vietnam?

According to Article 92 of Decree 145/2020/ND-CP, to become a labor mediator, individuals meet the following conditions:

- Be a Vietnamese citizen; have full legal capacity as prescribed by the Labor Code, good health and moral qualities.

- Have at least a bachelor’s degree and 03 years’ experience in a field relevant to labor relation.

- Not be facing criminal prosecution; not have any unspent conviction.

What will the recruitment and appointment for 2022 labor mediators be conducted in Ho Chi Minh City?

On April 14, 2022, the People's Committee of Ho Chi Minh City issued the Plan 1116/KH-UBND in 2022 on the recruitment and appointment of labor mediators in 2022, the recruitment and appointment for 2022 labor mediators are mentioned as follows:

Criteria for the recruitment and appointment of labor mediators

- Total of labor mediators: 132 people, including:

+ Number of labor mediators with the term of appointment: 69 people;

+ Number of supplemental labor mediators: 63 people.

- Total targets for the supplemental recruitment and appointment 2022: 63 people.

(Details of the number of mediators distributed and selected by district, Thu Duc city are in the attached Appendix).

Subjects and standards for registration

- Candidates must meet the following criteria:

- Be a Vietnamese citizen; have full legal capacity as prescribed by the Civil Code

+ Have good health and moral qualities.

+ Have at least a bachelor’s degree and 03 years’ experience in a field relevant to labor relations.

- Subjects are not eligible to apply

+ Loss of civil act capacity or restricted civil act capacity.

+ Be examined for penal liability or having completed the sentence but not yet have the criminal record cleared.

Application for recruitment

- Application for recruitment of labor mediators.

- Curriculum vitae certified by the agencies, organization or unit where you work or certified by the local government where you reside (for retired people).

- Health certificate issued by a competent health agency according to the regulations of the Ministry of Health.

- A copy from the master book, a certified copy or a copy presented with the original for comparison of relevant documents and certificates.

- Written introduction to participate as labor mediator of relevant agencies and organizations (if any).

Receipt and processing of of application documents

- The application period is from May 1, 2022 to May 15, 2022.

- Responsibilities for receipt of application:

+ Application of registration, introduction and selection of labor mediators of candidates are sent to the Department of Labor - Invalids and Social Affairs of districts, Thu Duc city to receive for review, comparison and synthesis for qualified application and sent to the Department of Labor, War Invalids and Social Affairs by May 31, 2022.

+ The Department of Labor, War Invalids and Social Affairs is responsible for receiving application of registration, introduction and selection labor mediators of candidates under the management of the Department of Labor, War Invalids and Social Affairs; receive dossiers sent by the Department of Labor - Invalids and Social Affairs of the district, Thu Duc city; review, appraise dossiers, synthesis and submit to the City People's Committee for consideration and appointment decision, no later than June 30, 2022.

- There is no recruitment fee for candidates as labor mediators.

What are the benefits for labor mediators in Vietnam?

According to Clause 1, Article 96 of Decree 145/2020/ND-CP, labor mediators are entitled to:

- A remuneration of 5% of the average of applicable monthly minimum wages of all regions prescribed by the Government if he/she is working under a employment contract (from January 01, 2021, the region-based minimum wages prescribed in the Government’s Decree No. 90/2019/ND-CP dated November 15, 2019 shall apply) for each day of performing the labor mediator’s duties as assigned by a competent authority.

The People’s Committees of provinces may propose benefits that are higher than those specified in this Point to People’s Councils of the same provinces within the budget of their provinces;

- Be enabled by their employers to perform labor mediators’ duties as per regulations;

- Be paid as officials and public employees for the performance of labor mediators’ duties as per regulations;

- Advanced training organized by competent authorities;

- Commendations for good performance of labor mediators' duties according to the Law on Emulation and Commendation;

- Other benefits prescribed by law.
