Which categories of defense workers are entitled to receive various allowances and benefits?

According to Article 2 of Decree 19/2017/ND-CP stipulated as follows:

Applicable Subjects

1. Defense workers as specified in Clause 2, Article 3 of the Law on Professional Soldiers, Defense Workers, and Public Employees.

2. Defense public employees as specified in Clause 3, Article 3 of the Law on Professional Soldiers, Defense Workers, and Public Employees.

3. Agencies, units, organizations, and individuals involved.

Accordingly, defense workers eligible for various allowances and benefits are the main workforce on the payroll of the People's Army, arranged according to job positions; carrying out tasks at manufacturing, repairing, renovating, and maintaining military weapons and technical equipment; ensuring and serving the tasks of combat readiness, combat, and other military tasks.

Based on Clause 2, Article 3 of Decree 19/2017/ND-CP, it is stipulated as follows:

Salary Regime for Defense Workers

2. Defense workers are entitled to various allowances and benefits including:

a) Out-of-frame seniority allowance;

b) Regional allowance;

c) Special allowance;

d) Hazardous and dangerous allowance;

e) Job responsibility allowance;

Conditions, duration, and rates of the allowances specified in points a, b, c, d, and e of this clause are executed in accordance with Decree No. 204/2004/ND-CP dated December 14, 2004, of the Government of Vietnam on salary regimes for officials and public employees and the armed forces.

f) Public service allowance:

- Applicable to defense workers paid from the state budget;

- Conditions, duration, and rates of the public service allowance are executed in accordance with Decree No. 34/2012/ND-CP dated April 15, 2012, of the Government of Vietnam on public service allowance policies.

g) Allowance and benefits for working in areas with particularly difficult socio-economic conditions:

Conditions, duration, and rates are executed in accordance with Decree No. 116/2010/ND-CP dated December 24, 2010, of the Government of Vietnam on policies for officials and public employees, and those who receive salaries from the armed forces working in areas with particularly difficult socio-economic conditions.

Thus, defense workers are entitled to the following allowances and benefits:

(1) Out-of-frame seniority allowance;

(2) Regional allowance;

(3) Special allowance;

(4) Hazardous and dangerous allowance;

(5) Job responsibility allowance;

(6) Public service allowance (Applicable to defense workers paid from the state budget);

(7) Allowance and benefits for working in areas with particularly difficult socio-economic conditions.

Additionally, defense workers are also entitled to seniority allowance policies as specified in Article 5 of Decree 19/2017/ND-CP.

What are the regulations on seniority allowance policies for defense workers?

According to Article 5 of Decree 19/2017/ND-CP, the seniority allowance policies for defense workers are stipulated as follows:

- Allowance level

+ Defense workers who have served in the regular forces of the military for a full 5 years (60 months) are entitled to a seniority allowance of 5% of their current salary plus position allowance and out-of-frame seniority allowance (if any); from the sixth year onward, an additional 1% for each full year (12 months) is added.

+ The seniority allowance is calculated and paid along with the monthly salary, and it is used to calculate and enjoy social insurance, health insurance, unemployment insurance, and labor accident and occupational disease insurance.

- Time counted for allowance

+ Time serving in the regular forces of the military;

+ The time of receiving seniority allowance in other sectors and occupations is accumulated with the time specified in point a of this clause to calculate the seniority allowance.

- Time not counted for allowance

+ Time on private leave without salary for a continuous period of 1 month or more;

+ Time on sick leave, maternity leave exceeding the duration specified by the law on social insurance;

+ Time of temporary suspension of work or detention, custody for investigation, prosecution, trial purposes.

The financial source for implementing this allowance policy is stipulated in Article 6 of Decree 19/2017/ND-CP as follows:

- For budget-dependent units, ensured by the state budget in accordance with the Law on State Budget and current guiding documents.

- For enterprises, it is counted in deductible expenses when determining taxable income of the enterprise.
