What to do when losing a regular passport?

Based on Clause 2, Article 28 of the Law on Exit and Entry of Vietnamese Citizens 2019, it is stipulated as follows:

2. The revocation of the validity of regular passports is stipulated as follows:

a) Within 48 hours from the discovery of the lost regular passport, the person who lost the passport directly submits or sends a loss report according to the form to the nearest Immigration Management Agency, the nearest police agency, the border controls at the port, or the Vietnamese representative agency abroad where convenient. In case of force majeure, the time limit for submitting or sending the loss report may be longer but must specify the reason for force majeure in the report;

b) Within 01 working day from the receipt of the loss report of the regular passport, the receiving agency is responsible for notifying according to the form to the Immigration Management Department of the Ministry of Public Security and the submitter. Within 01 working day from the receipt of the notice, the Immigration Management Department of the Ministry of Public Security shall revoke the validity of the passport.

Thus, according to the above regulations, immediately after discovering that a regular passport is lost, the person who lost the passport must directly submit or send a loss report to the competent authority within 48 hours from the discovery.

Including the following agencies:

- Convenient Immigration Management Agency;- Nearest Police Agency;- Border controls at the port;- Vietnamese representative agency abroad where convenient.

What are the procedures for reporting the loss of a regular passport?

Based on the content of Subsection 1, Section I, Part II of the list of procedures promulgated attached to the Decision No. 3191/QD-BCA in 2022 of the Minister of Public Security.

The procedures for reporting the loss of a regular passport include the following steps:

Step 1: Prepare the dossier

Vietnamese citizens who lose their regular passport in the country prepare the report dossier according to legal regulations.

Step 2: Submit the dossier

- Vietnamese citizens who lose their regular passport in the country must report the loss through the National Public Service Portal, the Ministry of Public Security Public Service Portal, via public postal services, or at one of the two offices of the Immigration Management Department - Ministry of Public Security:

+ 44-46 Tran Phu Street, Ba Dinh District, Hanoi City.+ 333-335-337 Nguyen Trai Street, District 1, Ho Chi Minh City.

Or at the immigration control units under the Department of Immigration Management, Ministry of Public Security.

When submitting the dossier, it is necessary to present an identification card or citizen identification card that is still valid for verification and comparison.

- Dossier reception time: From Monday to Saturday morning weekly (excluding Tet holiday and public holidays).

- Dossier receiving officers check the legality and content of the dossier:+ If the dossier is complete and valid, it will be accepted.+ If the dossier is incomplete or invalid, guide the reporter to complete the dossier following the regulations.

Step 3: Receive the result

- In the case of direct submission and requesting to receive the result via postal services, follow the instructions of the postal service provider.- In the case of sending the dossier by postal service, the Immigration Management Department sends a notice of processing the loss report via postal service based on the sender's dossier information.- Result reception time: From Monday to Friday weekly (excluding Tet holiday and public holidays).

How is the restoration of the validity of a regular passport regulated?

Based on the provisions of Article 32 of the Law on Exit and Entry of Vietnamese Citizens 2019, the restoration of the validity of a regular passport is regulated as follows:

- The regular passport that has been revoked due to being lost in the country, if found intact and still has valid visas issued by foreign countries, can be considered for restoration.- The applicant for restoration of the passport’s validity must fill in the information in the form attached to the passport and submit it to the Immigration Management Department of the Ministry of Public Security or the Provincial Immigration Management Department where convenient.- The assigned person is responsible for receiving, checking, comparing the information in the form with the passport information, and issuing an appointment slip for the result.- The restoration of the validity of the regular passport is conducted at the Immigration Management Department of the Ministry of Public Security.- Within 03 working days from the date of receiving the request, the Immigration Management Department of the Ministry of Public Security shall return the passport with restored validity to the applicant; if refusing to restore the passport's validity, a written response stating the reason must be provided.- Within 05 working days from the date of receiving the request, the Provincial Immigration Management Department shall return the passport with restored validity to the applicant; if refusing to restore the passport's validity, a written response stating the reason must be provided.
