What are the aggravating circumstances of the disciplinary level for violating communist party members in Vietnam?
Pursuant to Clause 2, Article 6 of Regulation 69-QD/TW of Vietnam in 2022, stipulating the aggravating circumstances of the disciplinary level for communist party members who violate as follows:

2. For Communist party members in Vietnam
a) It has been requested by the Communist party organization for a review but fails to implement it or correct its shortcomings or violations. Failure to voluntarily acknowledge defects, violations, and form of discipline commensurate with the content, nature and seriousness of the violation; causing material damage must be compensated but not reimbursed, not remedied or corrected improperly at the request of the competent authority, failed to voluntarily return money and property obtained from the violation.
b) Dealing with, winding up, obstructing the process of inspection, supervision, inspection, audit, investigation, prosecution, adjudication and judgment enforcement. Cover for violators; threaten, punish, and take revenge on those who fight, denounce, witness, provide documents and evidences of violation.
c) Organized violations, being the masterminds; provide false information or reports; prevent others from providing evidence of violations; conceal, correct, destroy evidences, create fake documents, records and evidences.
d) Abusing positions and powers, taking advantage of emergency situations, natural disasters, fires, epidemics to implement social security and defense and security policies for self-seeking purposes. Forcing, mobilizing, organizing or abetting others to commit the same violations.
This is guided by subsection 4, Section I of the Guidelines 05-HD/UBKTTW of Vietnam in 2022 which provides as follows:
I. General provisions

4. Circumstances aggravating the disciplinary level (Article 6)
4.1. A communist party organization or communist party member who commits violations many times or is disciplined many times is a violation or disciplined for the second time or more, including previous violations or discipline on administration, mass organizations and forms of legal handling.
4.2. An organized violation is a violation involving collusion, discussion and agreement among communist party organizations or communist party members who commit the same violation.
Thus, the circumstances aggravating the disciplinary level for the communist party members who violate the disciplinary action include the circumstances specified above.
What are the extenuating circumstances of the disciplinary level for violating Communist party members in Vietnam?
According to Article 5 of Regulation 69-QD/TW of Vietnam in 2022, the extenuating circumstances the disciplinary level for communist party members who violate are as follows:
Circumstances extenuating the level of discipline
In case of violation with one or more of the following circumstances, the disciplinary level shall be considered and reduced:
1. For communist party organization
a) Proactively and promptly report violations to superior communist party organizations, have a serious attitude of review, voluntarily acknowledge shortcomings and violations and accept disciplinary measures commensurate with violations.
b) Take the initiative in providing information, documents and evidence to fully and honestly reflect the violation.
c) Actively terminate violations and basically and promptly remedy the consequences caused by their organization's violations before and during the inspection and supervision process.
d) To assist competent communist party organizations in examining, considering and accurately and promptly handling violating organizations and individuals.
2. For Communist party members
a) Actively report their violations to the communist party organization, voluntarily accept personal responsibility for shortcomings and violations, and self-recognise a form of discipline commensurate with the content, nature and seriousness of the violation before and during inspection and supervision.
b) Actively provide information, records and documents, fully and truthfully reflect on co-violators.
c) Actively terminate violations, actively participate in preventing violations; voluntarily submit corrupt assets, compensate for damage, and remedy the consequences caused by them.
d) Violation when implementing the policy or piloting innovation as permitted by the competent authority as prescribed, other than the case specified at Point dd, Clause 14, Article 2 of this Regulation.
Thus, mitigating circumstances for Communist party members in violation include:
- Actively report their violations to the communist party organization, voluntarily accept personal responsibility for shortcomings and violations, and self-recognize a disciplinary form commensurate with the content, nature and severity of the violation before and during inspection and monitoring process.
- Actively provide information, records and documents, fully and honestly reflect on the same violators.
- Actively put an end to violations, actively participate in preventing violations; voluntarily submit corrupt assets, compensate for damage, and remedy the consequences caused by them.
- Violation when implementing the policy or piloting innovation and creativity as permitted by the competent authority as prescribed, other than the case specified at point dd, clause 14, Article 2 of Regulation 69-QD/TW in 2022.
