The People's Committee has recently issued Plan 105/KH-UBND to organize fireworks in the "Hai Phong - Illuminating the Heritage" Royal Poinciana Festival 2024.
The fireworks display in celebration of the 2024 Royal Poinciana Festival is associated with the commemoration of the 69th anniversary of the Liberation of Hai Phong (May 13, 1955 - May 13, 2024). It aims to create a joyful and exciting atmosphere for the city's people during the festival, as well as contribute to the development of tourism, promotion of the city's image and its people, and the sustainable socio-economic development of the city.
Accordingly, the People's Committee requests close coordination and thorough preparation from the departments, agencies, localities, and contracted units to organize the fireworks in accordance with the plan, ensuring security and order, cost-effectiveness, high artistic quality, and absolute safety for both people and equipment.
(1) Venue: at the Political-Administrative Center Square in the North Cam River New Urban Area, Thuy Nguyen District, Hai Phong City.
(2) Fireworks duration: 15 minutes on the evening of May 11, 2024 (Saturday).
- First round: 1-minute display after the city's leaders' speech.
- Second round: 14-minute display before the end of the artistic program by 5 minutes.
(3) Quantity and shooting direction:
- Number of high-altitude fireworks: 500 shells, 150 low-altitude fireworks.
- Shooting direction: Straight (angle from 85° to 90°).
- Unsafe area: 50m radius around the shooting site

What are the prohibited acts related to management and use of pyrotechnics in Vietnam?
Pursuant to the provisions of Article 5 of Decree 137/2020/ND-CP, prohibited acts related to management and use of pyrotechnics include:
- Conducting research, making, manufacturing, trading, importing, exporting, storing, transporting, using or appropriating fireworks; except for organizations and enterprises affiliated to Ministry of National Defense assigned by the Prime Minister to conduct research, manufacture, import, export, provide, transport and/or use fireworks according to this Decree.
- Conducting research, creating, manufacturing, trading, importing, exporting, storing, transporting or using consumer fireworks or pyrotechnic compositions illegally.
- Carrying pyrotechnics or pyrotechnic compositions into or out of territory of Socialist Republic of Vietnam or into restricted areas, restricted zones, protected areas and protected targets.
- Abusing or exploiting pyrotechnics to violate national security, social order, safety, life, health, property, legal rights and benefits of agencies, organizations and individuals.
- Exchanging, gifting, giving, sending, borrowing, lending, hiring, leasing or mortgaging fireworks or pyrotechnic compositions to illegally manufacture pyrotechnics; transporting, preserving or disposing pyrotechnics in an unsafe manner or in a manner that affects the environment.
- Appropriating, trading, exchanging, gifting, giving, borrowing, lending, hiring, leasing, mortgaging, fabricating, falsifying or modifying pyrotechnic-related certificates.
- Assigning fireworks or pyrotechnic compositions to ineligible agencies, organizations or individuals as per the law.
- Guiding, training, or organizing training on production, manufacturing or using pyrotechnics illegally in any shape or form.
- Intentionally providing false information on managing and preserving pyrotechnics or pyrotechnic compositions; failing to promptly report, concealing or falsifying information on losses, incidents or accidents related to pyrotechnics and pyrotechnic compositions.
How much is the fine for illegal use of fireworks in Vietnam?
Pursuant to Point i, Clause 3, Article 11, Point a, Clause 7, Article 11 of Decree 144/2021/ND-CP:
Violations against regulations on management and use of weapons, explosive materials, explosive precursors, combat gears, fireworks, firecrackers, and dangerous banned toys

3. A fine ranging from 5.000.000 VND to 10.000.000 VND shall be imposed for any of the following violations:
a) Exchanging, giving away, sending, borrowing, lending, renting, leasing, pledging weapons, combat gears, explosive fireworks, smuggled fireworks or pyrotechnic compositions for illegal firework production; parts, assemblies of weapons, combat gears or scraps and refuses thereof;
b) Transporting or destroying weapons, explosive materials, explosive precursors or combat gears without ensuring safety or affecting the environment but not liable to criminal prosecution;
c) Failure to carry out testing, inspection, assessment and registration as prescribed by regulations of law on management of product quality before initiation production, sale, use of weapons or combat gears in Vietnam;
d) Illegal storage, transport of junk and scrap of weapons and combat gears;
dd) Transport, storage of dangerous banned toys;
e) Selling explosive precursors to an organization or enterprise that has not been granted the certificate of security and order, certificate of eligibility to manufacture industrial explosives, license for sale of explosive precursors or written approval issued by a competent authority;
g) Losing provided cold weapons or combat gears;
h) Using weapons or combat gears without a license;
i) Illegal use of firecrackers, fireworks or pyrotechnic compositions;
k) Manufacturing, providing, storing, transporting, repairing weapons or combat gears with a license but failing to comply with regulations of law.

7. Additional penalties:
a) Confiscation of the exhibits and means of administrative violations for the violations specified in Points d and dd Clause 1, Points a, b, c, e and g Clause 2; Points a, c, d, dd, e, h, i and k Clause 3; Points a, b, c, d, dd, e, h and I Clause 4 and Clause 5 of this Article;

Thus, persons commiting an illegal use of firecrackers, fireworks or pyrotechnic compositions shall be imposed a fine ranging from 5.000.000 VND to 10.000.000 VND
In addition, there are additional penalties of confiscation of the exhibits and means of administrative violations.
* Note: This is the fine level applicable to individuals. Violating organizations will be subject to a fine 2 times higher than the fine for individuals (as prescribed in Clause 2, Article 4 of Decree 144/2021/ND-CP).
