What is product origin tracing in Vietnam?

Pursuant to Article 3 of Circular 02/2024/TT-BKHCN, product origin tracing is the activity of monitoring and determining the identity of a product or service through each stage of its production, processing, storage, preservation, transportation, distribution, and business, including tracking its time and location

What are the responsibilities of organizations and individuals implementing product origin tracing in Vietnam?

(1) Responsibilities of organizations and individuals implementing product origin tracing (Article 10 of Circular 02/2024/TT-BKHCN):

- Comply with the regulations on product origin tracing stated in Circular 02/2024/TT-BKHCN.

- Implement the disclosure of a suitable product origin tracing system according to national standards, national technical regulations, international standards, and corresponding regional standards.

- Assume legal responsibility for the information related to product origin tracing as stipulated in Circular 02/2024/TT-BKHCN.

- Be subject to inspection, examination, and supervision by competent state management agencies regarding product origin tracing according to legal provisions.

- In case of connecting information to the national product origin tracing portal, update the product origin tracing data in a timely manner for each production and business stage on the national product origin tracing portal. Organizations and individuals must cooperate with the General Department of Standards, Metrology, and Quality Assurance to implement and ensure the maintenance of data on the national product origin tracing portal.

(2) Responsibilities of organizations and individuals providing services and solutions for product origin tracing (Article 11 of Circular 02/2024/TT-BKHCN):

- Provide services and solutions for product origin tracing that meet the requirements specified in Circular 02/2024/TT-BKHCN.

- Assume legal responsibility for the services and solutions provided to relevant organizations and individuals regarding product origin tracing.

- In case organizations and individuals providing services and solutions for product origin tracing have a need to connect with the national product origin tracing portal, they must cooperate with the General Department of Standards, Metrology, and Quality Assurance to implement and ensure the maintenance of data on the national product origin tracing portal.

- Be subject to inspection, examination, and supervision by competent state management agencies regarding product origin tracing according to legal provisions.

What are the responsibilities of the People's Committees of provinces and centrally governed cities in managing product origin tracing in Vietnam from June 1, 2024?

Pursuant to Article 9 of Circular 02/2024/TT-BKHCN, the responsibilities of the People's Committees of provinces and centrally governed cities in managing product origin tracing in 2024 are as follows:

- Implement the provisions stated in Clause 3 of Article 19 of Decree 132/2008/ND-CP by the Government, as supplemented by Clause 3 of Article 1 of Decree 132/2008/ND-CP by the Government.

- Assign advisory agencies to assist the People's Committees of provinces and centrally governed cities in implementing state management of product origin tracing at the local level according to the regulations in Clause 13 of Article 8 of Decree 24/2014/ND-CP by the Government, which regulates the organization of specialized agencies under the People's Committees of provinces and centrally governed cities.

+ Take the lead and coordinate with the General Department of Standards, Metrology, and Quality Assurance in guiding the application, organizing dissemination, training, implementation, and management of origin tracing at the local level. Also, collaborate with the General Department of Standards, Metrology, and Quality Assurance to exploit, provide, and search for information on the national product origin tracing portal to serve state management at the local level.

+ Take the lead and coordinate with the General Department of Standards, Metrology, and Quality Assurance and relevant agencies in managing, inspecting, and handling violations related to product origin tracing at the local level.

+ Based on the actual situation at the local level, develop implementation plans, allocate necessary resources to carry out activities related to product origin tracing annually, in the medium term, and in the long term at the local level. Report to the People's Committees of provinces and centrally governed cities for consideration and approval.

+ Develop appropriate plans to encourage, attract, and support businesses in building their own product origin tracing systems using their resources and other support sources. Report to the People's Committees of provinces and centrally governed cities for consideration and decision-making.

- Regularly report the implementation status of activities for product origin tracing at the local level, using the reporting template, to the Ministry of Science and Technology (through the General Department of Standards, Metrology, and Quality Assurance) for consolidation and reporting to the Prime Minister.

The deadlines for data closure, report submission, and the method of submission and receipt of reports shall be in accordance with the regulations stated in Circular 13/2021/TT-BKHCN by the Minister of Science and Technology.

Circular 02/2024/TT-BKHCN comes into force from June 1, 2024.
