Pursuant to Announcement 69/2020/TB-LPQT regarding the effectiveness of the 2019 Land Border Demarcation Treaty between Vietnam and Cambodia;

The Land Border Demarcation Treaty between the Socialist Republic of Vietnam and the Kingdom of Cambodia, signed in Hanoi on October 5, 2019, became effective on December 22, 2020.

According to the treaty, the purpose of signing the 2019 Land Border Demarcation Treaty between Vietnam and Cambodia is to acknowledge and legalize the achievements made in the work of border demarcation and border marker planting on the land border between the two countries (approximately 84%).

What is the overview of the land border according to the 2019 Land Border Demarcation Treaty between Vietnam and Cambodia?

Pursuant to Article 2 of the 2019 Land Border Demarcation Treaty between Vietnam and Cambodia, the overview of the land border is determined as follows:

- The starting point of the Vietnam-Cambodia land border is the intersection of the border between the Socialist Republic of Vietnam, the Kingdom of Cambodia, and the Lao People's Democratic Republic, as defined in the "Agreement on the Determination of Border Intersection between the Socialist Republic of Vietnam, the Kingdom of Cambodia, and the Lao People's Democratic Republic," signed on August 26, 2008, and described in detail in Part II of the treaty.

- The end point of the Vietnam-Cambodia land border is the position of the main border pillar with the number 314, as stipulated in Clause 2 Article 1 of the 2019 Supplementary Agreement and described in detail in Part II of the treaty. This point is also the starting point of the maritime border between the two countries.

- The total length of the Vietnam-Cambodia land border that has completed the demarcation and border marker planting work is 1,044.985 kilometers, with 488.148 kilometers on land and 556.837 kilometers on rivers and streams.

- The direction of the border, the position of the main and subsidiary border markers, boundary posts, and distinctive points are described in detail in Part II of the treaty and depicted on the 1/25,000 scale Vietnam-Cambodia Border Topographic Map signed on October 5, 2019 - Appendix 1 attached to the treaty.

Pursuant to Article 35 of the Law on National Border 2003 as follows:

Contents of state management on national border include:
1. Develop and direct implementation of strategy and policies regarding the national border;
2. Promulgate and implement legislative documents regarding national border, policies and regimes regarding construction, management and defense of the national border;
3. Negotiate, sign and implement international agreements on national border;
4. Publicize, popularize and raise awareness regarding national border laws;
5. Decide to establish border constructions, socioeconomic constructions in border areas;
6. Conduct research, apply science and technology serving the construction, management and defense of the national border;
7. Develop primary and specialized force; train and improve expertise and operation regarding management and defense of the national border;
8. Inspect, examine and handle complaints, accusations and take actions against violations regarding national border;
9. Participate in international agreement on construction, management and defense of the national border.

Thus, contents of state management on national border include:

- Develop and direct implementation of strategy and policies regarding the national border;

- Promulgate and implement legislative documents regarding national border, policies and regimes regarding construction, management and defense of the national border;

- Negotiate, sign and implement international agreements on national border;

- Publicize, popularize and raise awareness regarding national border laws;

- Decide to establish border constructions, socioeconomic constructions in border areas;

- Conduct research, apply science and technology serving the construction, management and defense of the national border;

- Develop primary and specialized force; train and improve expertise and operation regarding management and defense of the national border;

- Inspect, examine and handle complaints, accusations and take actions against violations regarding national border;

- Participate in international agreement on construction, management and defense of the national border.

Thus, the Government shall perform joint state management on national border; specify tasks, powers and responsibilities for cooperation between ministries, ministerial agencies, People’s Committees of provinces and central-affiliated cities where the national border situated in order to implement state management on national border.

Ministry of National Defense shall take charge and cooperate with Ministry of Foreign Affairs and Ministry of Public Security to be responsible to the Government for implementation of state management on national border.

Ministries, ministerial agencies within their tasks and powers shall perform state management on national border.

People’s Committees of all levels where the national border situated shall perform state management on national border as per the law
