Decision 2544/QD-BCT in 2022 announcing new, amended and supplemented administrative procedures in the field of chemicals within the scope of functions and management of the Ministry of Industry and Trade, issued on November 28, 2022.
What are industrial precursors? What are the conditions for production and trading of industrial precursors in Vietnam?
Pursuant to Clause 5, Article 3 of Decree 113/2017/ND-CP, the concept is as follows:
- “industrial precursor chemicals” are chemicals used as raw materials, solvents, catalysts in production, scientific research, analyses, testing, and are indispensable chemicals used in the preparation process and production of narcotics and specified in the list issued by the Government. The list of industrial precursor chemicals shall be classified into 2 groups according to their hazards to manage and supervise:
+ “Group 1 industrial precursor chemicals” are indispensable chemicals used in the preparation process and production of narcotics;
+ “Group 2 industrial precursor chemicals” are indispensable chemicals used as reagents or solvents in the preparation process and production of narcotics.
At the same time, based on Article 11 of Decree 113/2017/ND-CP, a number of regulations are annulled by Clause 2, Article 9 of Decree 17/2020/ND-CP, such as requirements for production and trade in industrial precursor chemicals as follows:
*Production requirements
- A producer of industrial precursor chemicals shall fulfill the requirements specified in Clause 1 Article 9 herein, production requirements prescribed in Articles 4, 5, 6 and 7 herein and the following requirements:
+ A logbook should be prepared to record the industrial precursor chemical production. Such logbook shall specify the produced precursor chemicals, inventories, sold precursor chemicals, headquarters’ address, phone and fax numbers, use purposes of industrial precursor chemicals of the buyer;
*Trading requirements
- The trader of industrial precursor chemicals shall fulfill the requirements specified in Clause 2 Article 9 herein, trading requirements prescribed in Articles 4, 5, 6 and 7 herein and the following requirements:
+ There are sufficient invoices and documents proving origins, producers, importers or suppliers of industrial precursor chemicals;
+ A logbook should be prepared to record information about industrial precursor chemicals. Such logbook shall specify the name and address of the headquarters, phone and fax numbers; names of industrial precursor chemicals, purchased and sold industrial precursor chemicals, inventories; use purposes of industrial precursor chemicals of the buyer;
- During the production or trading process, the producer or trader shall manage and control industrial precursor chemicals and take responsibility for loss of industrial precursor chemicals (if any).

Pursuant to subsection A, section 2, part II of the Appendix issued together with Decision 2544/QD-BCT in 2022, clearly stating how to submit documents to carry out procedures for issuance of a license to export or import industrial precursors Provincial chemical sector in 2023 only need to submit through the National Single Window Portal at https://vnsw.gov.vn/ without having to do it directly.
(Accordingly, the Vietnam National Single Window Portal is an integrated information system to carry out customs procedures and other administrative procedures related to exported, imported and transited goods; people and vehicles on exit, entry, transit)
What is the procedure for issuing the latest import and export license for industrial precursor chemicals in Vietnam in 2023?
Pursuant to subsection A, section 2, part II of the Appendix issued together with Decision 2544/QD-BCT in 2022, the procedures for applying for a provincial license to export and import industrial precursors in the chemical sector in 2023 is done as follows:
- Organizations and individuals applying for a license to export and import industrial precursors shall make 01 set of dossiers and send them through the National Single Window Portal at https://vnsw.gov.vn/
- In case the dossier is incomplete and invalid, within 03 working days from the date of receiving the dossier, the licensing agency shall notify the organization or individual to supplement and complete the dossier. The time to complete the application is not included in the licensing time
- Within 07 working days from the day on which the complete and valid dossier is received, the licensing agency shall examine the dossier and grant the license to export and import industrial precursors.
- In case of refusal to grant a license, the licensing authority must reply in writing and clearly state the reasons therefor.
- Implementing agency: Ministry of Industry and Trade (Department of Chemicals).
- Processing time: 7 working days from the date of receipt of complete and valid dossiers.
- Subjects of implementation: Organizations and individuals exporting and importing industrial precursors
- Implementation results: License to export and import industrial precursors
