What are the duties and powers of the Vietnam Ministry of Finance in the administration of taxes, fees, charges, and other revenues of the state budget?
Pursuant to Clause 6 Article 2 of Decree 14/2023/ND-CP, the duties, and powers of the Vietnam Ministry of Finance in the administration of taxes, fees, charges, and other revenues of the state budget are:
- Unify the management, direction, and inspection of the organization of the collection of taxes, fees, charges, and other revenues of the state budget in accordance with the provisions of law for tax and customs agencies and other agencies assigned by the state to collect fees, fees or other revenues of the state budget.
- Take charge of, and coordinate with relevant agencies in, formulating, and submitting to competent authorities for promulgation and guiding and examining the implementation of legal documents on taxes, fees, charges, collection of land use levies, land, and water surface rentals, rental proceeds, and sale proceeds of state-owned houses, registration fees and other revenues of the state budget in accordance with the provisions of law.
- Decide according to its competence or submit to the Prime Minister for decision the tax exemption, tax reduction, tax refund, tax arrears, write-off of tax debts, fines, and other revenues of the state budget or abolition of other penalties for violations of tax legislation in accordance with the provisions of law and issues arising in the process implementation of bilateral or multilateral international treaties on taxation.
- Promulgate regulations on procedures and professional processes for collection and payment of taxes, fees, charges, and other revenues of the state budget in accordance with law; guiding operations: Tax declaration, tax calculation, tax payment, issuance of tax collection orders and other related operations.
- Inspect and control the revenues of the state budget, the observance of the provisions of law on collection and payment of the state budget, and handle according to its competence violations of the law on taxes, fees, charges and other revenues of the state budget in accordance with the provisions of law.
- Assess the conformity of policies on taxes, fees, charges, and other revenues of the State budget with other current mechanisms and policies and the socio-economic situation in each period in order to adjust, amend and supplement according to their competence or propose competent agencies to promptly adjust amendments and supplements.
What are the duties and powers of the Vietnam Ministry of Finance in the state management of securities and securities market?
Pursuant to Clause 13 Article 2 of Decree 14/2023/ND-CP, the duties and powers of the Vietnam Ministry of Finance in the state management of securities and securities market are:
- Formulate and submit to the Government for promulgation policies on securities market development;
- Formulate and submit to the Prime Minister for the decision on the establishment, dissolution, operation model, ownership form, functions, rights and obligations of the Vietnam Stock Exchange and the establishment of subsidiaries of the Vietnam Stock Exchange, Vietnam Securities Depository and Clearing Corporation.
- Grant, re-grant, extend, adjust, and revoke securities practice licenses and certificates related to securities and securities market activities; approve changes, suspensions, and cancellations related to securities and securities market activities in accordance with law.
- Manage, supervise, inspect and inspect securities and securities market activities; manage securities and securities market service activities in accordance with the provisions of law.
- Preside over and coordinate with relevant agencies in applying measures to ensure the security and safety of the securities market.
