How to ask for the opinion of the Deputy Minister of Transport of Vietnam on the program of formulation of legal documents?
Pursuant to Article 15 of Circular 26/2022/TT-BGTVT stipulating as follows:
Issue the Program
1. Based on the proposal of the Departments, Departments, enterprises, and other agencies and organizations under the Ministry, the Legal Department drafts the Program, and reviews and organizes consultations from agencies and the Ministry for the document formulation.
2. Based on the opinions of agencies and units under the Ministry, the Legal Department revised and completed the draft Program; consult the Deputy Ministers in charge, and submit them to the Minister for consideration and promulgation before December 31 of each year.
3. After the Minister signs for promulgation, the Information Technology Center is responsible for posting the Decision on Promulgation of the Program on the Ministry's e-portal.
According to the above regulations, the Legal Department relies on the opinions of agencies and units to revise and complete the draft program for formulation of legal documents to consult the Deputy Minister in charge first and then submit it to the Minister before December 31 of each year.
How to ask for the opinion of the Deputy Minister of Transport of Vietnam for drafting legal documents?
Pursuant to Article 28 of Circular 26/2022/TT-BGTVT stipulating the consultation of the Deputy Minister of Transport for draft legal documents as follows:
- For legal documents to be submitted to the Government, the Prime Minister, and the submitting advisory agency are responsible for sending the revised draft of legal documents after receiving appraisal opinions of the Ministry of Justice to consult the Deputy Minister in charge according to the form specified in Appendix III issued with this Circular, enclosed with the dossier specified at Points c, d, e and k, Clause 1, Article 29 of this Circular. In case the contents of the document are related to the fields of other Deputy Ministers, the opinions of those Deputy Ministers must be sought.
- For circulars, the submitting advisory agency is responsible for sending the revised draft circular after receiving the appraisal opinion of the Legal Department for the opinion of the Deputy Minister in charge according to the form specified in the Appendixes. III promulgated together with this Circular, enclosed with the documents specified at Points b, c, d, dd, Clause 2, Article 29, and Points b, c, d, dd, Clause 2, Article 30 of this Circular. In case the contents of the document are related to the fields of other Deputy Ministers, the opinions of those Deputy Ministers must be sought.
- The Deputy Ministers shall return their opinions to the advisory agency within no more than 03 working days from the date of receipt of the opinion form, except in case of absence on business trips.
- The submitting advisory body is responsible for synthesizing and absorbing the opinions of the Deputy Ministers. In case there are different opinions, the consulting agency shall summarize and report to the Minister and propose a plan for absorption.
- In the process of elaborating legal documents, the Deputy Minister in charge is responsible for organizing at least 01 meeting with relevant agencies, organizations, and individuals to agree on the content of the draft document before submission to the Minister for signature and promulgation.
