The Ministry of Labor, War Invalids and Social Affairs has just issued Notification 1570/TB-BLDTBXH in 2024 on proposed swap of working days during the Reunification Day (April 30th) and international Workers' Day (May 1st) holiday of 2024 for officials, public employees and employees of State administrative agencies, public service providers and enterprises.

Officials, public employees and employees of State administrative agencies and public service providers (hereinafter referred to as "officials and public employees") will have their working day of April 29th 2024 (Monday) swapped with May 4th 2024 (Saturday).

This means they will have 05 consecutive days off from April 27th 2024 (Saturday) to May 1st 2024 (Wednesday) for the Reunification Day and International Workers' Day holiday of 2024. May 4th 2024 (Saturday) will be the compensatory working day.

Moreover, agencies and units that do not take automatic days-off on Saturday and Sunday every week shall arrange their own holiday schedules in accordance with regulations of law.

Where:

(1) Schedule for the Reunification Day (April 30th) and international Workers' Day (May 1st) holiday for Vietnamese officials and public employees who take automatic days-off on Saturday and Sunday every week

(2) Schedule for the Reunification Day (April 30th) and international Workers' Day (May 1st) holiday for Vietnamese officials and public employees who do not take automatic days-off on Saturday and Sunday every week

Pursuant to Notification 1570/TB-BLDTBXH in 2024

Employers at enterprises are encouraged to apply the same holiday schedule to their employees as that applied to officials and public employees, provided their employees receive all the benefits as prescribed by law. Agreements that are more beneficial for employees are encouraged

Thus, if employers at enterprises apply the same holiday schedule of Reunification Day (April 30th) and international Workers' Day (May 1st) to their employees as that applied to officials and public employees, employees at enterprises shall be entitled to 4-5 consecutive days off.

If the employers at enterprises don't apply the same holiday schedule, employees at enterprises shall be entitled to 2 days off on April 30th and May 1st according to Labor Code.

Specifically, each case is as follows:

(1) For enterprises with fixed days off on Saturdays and Sundays

1.1. If employers at enterprises apply the same holiday schedule on April 30th and May 1st as that applied to officials and public employees

>> a continuous 5-day off from Saturday, April 27th, 2024, until Wednesday, May 1st, 2024 (compensating by working on Saturday, May 4th, 2024)

Specifically:

1.2. If employers at enterprises don't apply the same holiday schedule on April 30th and May 1st as that applied to officials and public employees

>> 2 days off on April 30th and May 1st

(2) For enterprises with fixed day off on Sundays

2.1. If employers at enterprises apply the same holiday schedule on April 30th and May 1st as that applied to officials and public employees

>> a continuous 4-day off from Sunday, April 28th, 2024, until Wednesday, May 1st, 2024 (compensating by working on Saturday, May 4th, 2024)

2.2. If employers at enterprises don't apply the same holiday schedule on April 30th and May 1st as that applied to officials and public employees

>> 2 days off on April 30th and May 1st

Note: In case public holiday falls on an employee’s weekly break, employees will have compensatory time-off on the next working days

How much are salaries for employees working in Vietnam on April 30th - May 1st, 2024?

Pursuant to the provisions of Article 98 of the 2019 Labor Code, regulations on overtime pay, night work pay are as follows:

Overtime pay, night work pay

1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:

a) On normal days: at least 150%;

b) On weekly days off: at least 200%;

c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.

2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.

3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.

4. The Government shall elaborate this Article.

Therefore, in the case that employees work on holidays and Tet, they will receive a salary of at least 300%, not including public holiday's salary for employees who are entitled to daily wages.

Additionally, if employees work at night, they will receive an additional payment of at least 30% of the normal working day's salary and 20% of the public holiday's salary.

Therefore, the salary calculation for working during public holidays is as follows:

- Working during the daytime: Receive at least 400% of the salary.

- Working at night: Receive at least 490% of the salary.
