How many days in advance should employees be notified of the holiday schedule for Vietnam National Day?
Pursuant to the provisions of subsection 5 of Notice 5034/TB-LDTBXH in 2022 as follows:
5. With regard to workers other than the ones prescribed in Clause 1 of this Announcement, employers may adopt the following holiday schedule for Lunar New Year and National Day in 2023:
- The Lunar New Year holiday may include 01 ending day of the year 2022 and 04 beginning days of the year 2023 of the lunar calendar, or 02 ending days of the year 2022 and 03 beginning days of the year 2023 of the lunar calendar, or 03 ending days of the year 2022 and 02 beginning days of the year 2023 of the lunar calendar.
- The National Day holiday will include September 02, 2023 (Saturday) and either September 01, 2023 (Friday) or September 03, 2023 (Sunday) of the solar calendar.
- The holiday schedule for Lunar New Year and National Day in 2023 must be notified to workers at least 30 days before implementation.
- In case a weekly day off coincides with a public holiday prescribed in Clause 1 Article 112 of the Labour Code, workers will have compensatory time-off on the next business day as prescribed in Clause 3 Article 111 of the Labour Code.
- Employers are encouraged to adopt the same Lunar New Year holiday schedule for their workers as officials and public employees.
Accordingly, for employees who are not officials, public employees and employees of administrative agencies, political organizations, and socio-political organizations, employees must inform notify employees of the plan to take a holiday on September 2, 2023, at least 30 days before the leave.
How to calculate salary for employees who work on Vietnam National Day?
Pursuant to the provisions of Article 98 of the Labor Code 2019 has the following provisions:
Overtime pay, night work pay
1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:
a) On normal days: at least 150%;
b) On weekly days off: at least 200%;
c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.
2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.
3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.
4. The Government shall elaborate this Article.
According to the above regulations, employees working on public holidays are entitled to a minimum wage of 300%. In particular, the above-mentioned overtime salary does not include salary on paid holidays.
Therefore, the employee's overtime pay during public holidays will be equal to 300% + 100% of holiday pay = 400%.
In addition, if employees work at night, they will be paid at least 30% of the salary of the normal working day and 20% of the salary of the holiday.
It is known that on September 2, 2023, employees will have 3 -4 days off, specifically:
- For those who have the regime of working and studying on Saturday, the National Day holiday of September 2, 2023 will be off for 3 days. Specifically:
+ Off on September 2 and 01 day before (ie Friday and Saturday) and 01 day off weekly (Sunday). That is from September 1 to September 3
+ Or Rest on September 2 and 01 day after that (ie Saturday and Sunday), will be compensated for 01 day off on Monday of the next week. That is from September 2 to September 4
- For those who do not have the regime to work and study on Saturday, the National Day holiday of September 2, 2023 will be closed for 4 days. Specifically:
+ If employees have a day off on September 2 and the previous day (ie Friday and Saturday), employees will be entitled to 1 day off every week (Sunday) and 1 day off on the next Monday. That is, from September 1 to September 4
+ Off on 2/9 and 01 day after that (ie Saturday and Sunday), employees will have 02 days off on Monday and Tuesday of the following week. That is, from September 2 to September 5
