Article 2 of Circular 11/2023/TT-BNV stipulates that from July 1, 2023, adjustments to the monthly allowance for elderly commune-level officials who have retired will be made under Article 2 of Decree 42/2023/ND-CP dated June 29, 2023, by the Government of Vietnam on adjusting pensions, social insurance benefits, and monthly allowances.
At point a, clause 3, Article 2 of Circular 11/2023/TT-BNV, the monthly allowance is specified (rounded up) as per clause 1 and clause 2 of Article 2 of Circular 11/2023/TT-BNV.
To be specific:
3. Based on the provisions in clause 1 and clause 2 of this Article, elderly commune-level officials who have retired will receive a monthly allowance from July 1, 2023 (rounded up) as follows:
a) For officials who were previously CPV Secretary, Chairperson of the Communal People's Committee, Deputy Secretary, Deputy Chairperson, Permanent CPV Committee member, Secretary of the People's Committee, Secretary of the Communal People's Council, Head of the Commune Military Command, Chief of Commune Police: 3,000,000 VND/month;

The previous allowance was specified at point a, clause 3, Article 2 of Circular 2/2022/TT-BNV.
3. Based on the provisions in clause 1 and clause 2 of this Article, the monthly allowance from January 1, 2022 (rounded up) for retired elderly commune-level officials is as follows:
a) For officials who were previously CPV Secretary, Chairperson of the Communal People's Committee: 2,473,000 VND/month;

Therefore, according to the above regulation, compared to the old allowance, the new monthly allowance has increased from 2,473,000 VND to 3,000,000 VND.
From July 1, the monthly allowance paid to a retired Chairperson of the Commune People's Committee is 3,000,000 VND.
* Note: Circular 11/2023/TT-BNV takes effect from September 15, 2023. However, increase in the monthly allowance for the retired Chairperson of the Commune People's Committee applies from July 1, 2023.

3. Chairperson and Vice Chairpersons of the People's Council; Chairperson and Vice Chairpersons of the People’s Committee;
a) Age: when officials participate in holding these positions for the first time, they must have served at least 01 term of office (60 months); For particular cases, they shall abide by decisions of authorities competent to manage officials;
b) Education level: officials must have graduated from high schools;
c) Professional level: officials must have tertiary education degrees. If otherwise prescribed by laws, regulations of such laws shall be applied;
d) Political theory level: officials must have graduated from intermediate schools or equivalent or higher;
dd) For other standards, regulations of the Law on Organization of the Local Government, relevant laws, regulations of the CPV and authorities competent to manage officials shall be applied.

What is the retirement of the Chairperson of the Commune People's Committee in Vietnam?
According to Article 28 of Decree 33/2023/ND-CP, the retirement of commune-level officials is specified as follows:
Retirement as commune-level officials
1. The retirement of commune-level officials shall comply with regulations of labor laws and regulations of the CPV and of social-political organizations at the central level.
2. Authorities competent to manage commune-level officials must notify in writing of retirement time 06 months before the dates on which commune-level officials retire; and promulgate retirement decisions 03 months before the dates on which commune-level officials retire.
Thus, based on the above regulations, the retirement of the Chairperson of the Commune People's Committee is as follows:
- The Chairperson of the Commune People's Committee shall retire in accordance with labor laws and regulations of the CPV and of social-political organizations at the central level.
- Six months prior to the Chairperson's retirement date, the competent authority managing these officials must notify in writing about the retirement date.
- Three months before the Chairperson's retirement date, the competent authority must issue a retirement decision.
