The processing of unemployment allowances claims via the Vietnam National Public Service Portal to be urged by the Government of Vietnam?
Pursuant to Official Letter 5653/VPCP-KSTT 2022 of the Government Office, there are guidelines for localities on urging the processing of applications for unemployment allowances on the Vietnam National Public Service Portal as follows:
- Over the past time, ministries, branches and localities have actively implemented the settlement of unemployment allowances on the National Public Service Portal according to the Government's Resolution No. 107/NQ-CP dated September 11, 2021 on the Government's regular meeting in August 2021 and the Prime Minister's Decision No. 06/QD-TTg dated January 6, 2022 approving the Project on developing the application of population data, identification and authentication serving the national digital transformation in the period of 2022-2025, with a vision to 2030. Besides, there is still the situation that some localities have not really paid attention to directing, leading to a backlog of overdue dossiers that cannot be approved people's frustrations; Some localities have not yet assigned administrative accounts to organizations and individuals competent to handle administrative procedures. To overcome the above situation, the Government Office respectfully proposes:
+ The Ministry of Labor, War Invalids and Social Affairs continues to urge, train and guide relevant agencies in receiving and digitizing dossiers and results of settlement of unemployment insurance benefits on the Service Portal. national public.
+ Vietnam Social Insurance continues to promote the results achieved in the past; pay attention and direct affiliated agencies and units to process online applications from the National Public Service Portal to ensure progress and quality according to regulations.
+ Chairpersons of People's Committees of provinces and cities direct the Department of Labor, War Invalids and Social Affairs and the Employment Service Center to focus on definitively handling overdue online applications on the National Public Service Portal (attached to the National Public Service Portal) and perform other public services to ensure progress and quality according to regulations; resolutely not to allow the situation of requiring additional submission of paper documents for online applications submitted on the National Public Service Portal in accordance with the provisions of Decree No. 45/2020/ND-CP dated April 8th, 2020. 2020 of the Government on the implementation of administrative procedures in the electronic environment.
+ Review and use the senior management account of the People's Committee of the province or city (registered with a digital certificate device issued to the Provincial People's Committee or an agency authorized by the Provincial People's Committee management) to decentralize the administrative account at the provincial level and the relevant organizations and individuals that have the authority to handle the above-mentioned administrative procedures. What are the conditions for unemployment allowance receipt in Vietnam?
Pursuant to Article 49 of the Law on Employment 2013 stipulates as follows:
Conditions for unemployment allowance receipt
A worker defined in Clause 1, Article 43 of this Law who currently pays unemployment insurance premiums may receive unemployment allowance when fully meeting the following conditions:
1. Terminating the labor contract or working contract, except the following cases:
a/ He/she unilaterally terminates the labor contract or working contract in contravention of law;
b/ He/she receives monthly pension or working capacity loss allowance.
2. Having paid unemployment insurance premiums for at least full 12 months within 24 months before terminating the labor contract or working contract, for the case specified at Points a and b, Clause 1, Article 43 of this Law; or having paid unemployment insurance premiums for at least full 12 months within 36 months before terminating the labor contract, for the case specified at Point c, Clause 1, Article 43 of this Law.
3. Having submitted a dossier for receipt of unemployment allowance to an employment service center under Clause 1, Article 46 of this Law.
4. Having not yet found any job after 15 days from the date of submission of the dossier for receipt of unemployment allowance, except the following cases:
a/ He/she performs the military or public security obligation;
b/ He/she attends a training course of full 12 months or longer;
c/ He/she serves a decision on application of the measure to send him/her to a reformatory, compulsory education institution or compulsory detoxification establishment;
d/ He/she is kept in temporary detention or serves a prison sentence;
dd/ He/she goes abroad for settlement or as guest worker;
e/ He/she dies.
Thus, the employee who currently pays unemployment insurance premiums may receive unemployment allowance when fully meeting the following conditions
What is the time limit for receipt of unemployment allowance in Vietnam?
Pursuant to Article 46 of the Law on Employment 2013 stipulates as follows:
Receipt of unemployment allowance
1. Within 3 months after terminating his/her labor contract or working contract, a worker shall submit a dossier for receipt of unemployment allowance to an employment service center established by the state management agency in charge of employment.
2. Within 20 days after the employment service center receives a complete dossier, the competent state agency shall issue a decision on unemployment allowance receipt; in case the worker is ineligible for receiving unemployment allowance, the center shall issue a written reply to the worker.
3. The social insurance organization shall pay unemployment allowance to the worker within 5 days after receiving a decision on unemployment allowance receipt.
Accordingly, the time to submit the application for unemployment allowances is within 3 months after terminating the worker’s labor contract or working contract.
