According to Article 3 of Circular 15/2016/TT-BYT (supplemented by Clause 1, Article 1 of Circular 02/2023/TT-BYT), the list of 35 occupational diseases covered by social insurance in 2023 includes:

What is the level of financial assistance in occupational disease treatment in Vietnam?

Pursuant to Clause 1, Article 21 of Decree 88/2020/ND-CP stipulates as follows:

Level of financial assistance in occupational disease treatment
1. The assistance is 50% of the costs of treatment of the occupational disease determined on the basis of list of prices of occupational disease treatment promulgated by Minister of Health at the time on which the employee had the occupational disease treatment and after health insurance payout has been provided, but such assistance must not exceed VND 15,000,000 per person.
2. The assistance is provided to each employee twice at the maximum and only once a year.

Thus, the assistance is 50% of the costs of treatment of the occupational disease determined on the basis of list of prices of occupational disease treatment promulgated by Minister of Health at the time on which the employee had the occupational disease treatment and after health insurance payout has been provided, but such assistance must not exceed VND 15,000,000 per person.

What is the application for financial assistance in occupational disease treatment in Vietnam?

Pursuant to Article 22 of Decree 88/2020/ND-CP stipulates as follows:

Application for financial assistance in occupational disease treatment
1. An application form for financial assistance in occupational disease treatment, which is made using the Form No. 07 in the Appendix hereof.
2. A certified true copy of the document certifying the employee contracts an occupational disease from the occupational health facility.
3. A copy of the hospital discharge paper or copy of the medical record after the occupational disease treatment.
4. Copies of documents evidencing payment of costs of occupational disease treatment.

Accordingly, in order to receive financial support for occupational disease treatment, workers need to prepare a complete set of documents including the following documents:

- An application form for financial assistance in occupational disease treatment, which is made using the Form No. 07 in the Appendix hereof.

- A certified true copy of the document certifying the employee contracts an occupational disease from the occupational health facility.

- A copy of the hospital discharge paper or copy of the medical record after the occupational disease treatment.

- Copies of documents evidencing payment of costs of occupational disease treatment.

What is the level of compensation for occupational accidents and diseases in Vietnam?

Pursuant to Clause 3, Article 3 of Circular 28/2021/TT-BLDTBXH regulating compensation for labor accidents and occupational diseases as follows:

3. Rate of compensation:
Compensation for workers suffering from occupational accidents is prescribed in points a and b clause 1 of this Article as follows:
a) At least a 30 months’ salary shall be paid for workers suffering from a work capacity reduction of at least 81% or for relatives of workers who died in occupational accidents or diseases.
b) At least a 1,5 month’s salary shall be paid for workers suffering from a work capacity reduction of between 5% and 10%; if workers suffer from a work capacity reduction of from 11% to 80%, a 0,4 month’s salary shall be added according to the following formula or Appendix I issued together with this Circular for every 1% increase in work capacity reduction percentage:
Tbt = 1,5 + {(a - 10) x 0,4}
Whereas:
- Tbt: amount of compensation for workers suffering from at least 11% work capacity reduction (unit: months’ salary);
- 1,5: amount of compensation for workers suffering from a work capacity reduction of from 5% to 10%;
- a: percentage (%) of work capacity reduction of workers suffering occupational accidents or diseases;
- 0,4: Coefficient of compensation when work capacity reduction percentage increases by 1%.
Example 1:
- Mr. A has suffered from an occupational disease and taken the first medical assessment to confirm a 15% work capacity reduction. The first compensation for Mr. A shall be calculated as follow:
Tbt = 1,5 + {(15- 10) x 0,4}= 3,5 (months’ salary).
- Periodically, Mr. A had 35% work capacity reduction in the second medical assessment (the work capacity reduction had increased by 20% compared to the first medical assessment). The second compensation for Mr. A shall be calculated as follow:
Tbt = 20 x 0,4 = 8,0 (months’ salary).

Thus, the compensation for workers suffering from occupational accidents is calculated as follows:

- At least a 30 months’ salary shall be paid for workers suffering from a work capacity reduction of at least 81% or for relatives of workers who died in occupational accidents or diseases.

- At least a 1,5 month’s salary shall be paid for workers suffering from a work capacity reduction of between 5% and 10%;

- If workers suffer from a work capacity reduction of from 11% to 80%, a 0,4 month’s salary shall be added.
