What does the registration application for parent and child recognition with foreign elements in Vietnam include?
Pursuant to the provisions of Subsection 4 Section B Part II of the Administrative Procedures promulgated together with Decision 528/QD-BTP in 2023, the registration application for parent and child recognition with foreign elements in Vietnam includes:
- Registration form for parent and child recognition (in case of directly submitting the application);
- Interactive electronic form for registration of parent and child recognition the applicant provide information according to the instructions on the Public Service Portal in case of submitting the application online);
The applicant shall submit/present (in person) or upload (online) the following documents:
* Documents to be submitted:
- Evidence proving the paternity, child relationship or mother-child relationship includes one of the following papers and documents:
+ Documents of health agencies, assessment agencies or other competent agencies and organizations in the country or abroad certifying paternity and mother-child relations.
+ In case there is no evidence proving the above-mentioned parent-child relationship, there must be a written affidavit of the parties receiving the father, mother and child, with at least two people witnessing the parent-child relationship.
- In case of registration of father, mother and child between Vietnamese citizens and foreigners or between foreigners, foreigners must submit copies of passports or valid documents instead of passports to prove their identity.
* Documents to be presented:
- Passport or identity card or citizen identity card or other documents with photos and personal information issued by competent agencies, still valid for proving the identity of the applicant.
In case the personal information in these documents is already in the database of the national park, the database is automatically filled in by the system, it is not required to upload (online);
- Valid documents proving residence information in case the civil status registration agency cannot exploit information about the residence of citizens
In case information on proof of residence documents has been extracted from the National Database on Population by these methods, the applicant is not required to present (in person) or upload (online).
Note:
- For documents submitted, present if the applicant submits the application in person:
+ The recipient is responsible for checking and comparing with the information in the declaration, taking or recording the information to keep in the file and returning it to the applicant, not being required to submit copies or copies of such documents.
+ A civil status registration applicant may submit a certified copy from the original or a copy issued from the original book or a photocopy enclosed with the original document for comparison. In case the applicant submits a photocopy together with the original document, the recipient is responsible for checking and comparing the photocopy with the original and signing the confirmation, not requiring the applicant to submit a copy of such document.
+ The recipient is responsible for receiving correct and sufficient civil status registration dossiers in accordance with the civil status law, and may not request the civil status registrant to submit additional papers that are not required by the civil status law.
- For accompanying documents if the applicant submits the application online:
+ Copies of documents sent together with online death registration dossiers must be clear, complete in content, be taken with cameras, phones or taken, or scanned by electronic devices, from validly issued documents, still valid.
+ In case papers and documents to be enclosed in the online application for registration of parent and child recognition already have electronic forms or electronic copies of civil status documents, the applicant may use this electronic copy.
+ Upon arrival at the civil status registration office to receive the results (Extract of registration of admission of father, mother, child/copy of Extract of registration of parent and child recognition) the applicant must present identification documents to determine their identity; submit original papers and documents that are evidence proving the paternity or mother-child relationship.
- Documents issued, notarized or certified by competent agencies of foreign countries to be used for civil status registration in Vietnam must be consular legalized in accordance with law, except for cases exempted under treaties to which Vietnam is a contracting party.
- In case the applicant fails to provide the above-mentioned documents as prescribed or the documents submitted or presented are erased, corrected or forged, the civil status registration agency shall have the authority to cancel the result of registration for admission of father, mother or child.
- Where a civil status registration applicant is allowed to make a written declaration on the contents of the civil status registration request, the civil status registration agency must clearly explain to the applicant about the responsibilities and legal consequences of the untrue assurance.
The civil status registration agency refuses to settle or request the competent authority to cancel the civil status registration result if there are grounds to determine that the content of the assurance is untrue.
What is the registration fee for parent and child recognition with foreign elements in Vietnam?
Pursuant to the provisions of Subsection 4 Section B Part II of the Administrative Procedures promulgated together with Decision 528/QD-BTP in 2023, the registration fee for parent and child recognition with foreign elements in Vietnam is:
- Specific fees shall be decided by the People's Councils of provinces and centrally-run cities.
- For persons who have contributed to the revolution; members of poor households; people with disabilities, the registration fee is not required.
- Fees for issuance of copies of extracts of registration of parent and child recognition (if required) shall comply with the provisions of Circular 281/2016/TT-BTC
