What is the latest Law on Residence in Vietnam in 2024?

On November 13, 2020, at the 10th session of the 14th National Assembly, the Law on Residence 2020 was passed, the Law takes effect from July 1, 2021.

The Law on Residence 2020 includes 07 chapters, 38 articles, including a number of new, amended and supplemented contents compared to the Law on Residence 2006 (amended and supplemented in 2013), specifically as follows:

- Chapter I GENERAL PROVISIONS, including 07 articles (from Article 1 to Article 7)

- Chapter II RIGHTS AND OBLIGATIONS CONCERNING RESIDENCE OF CITIZENS, including 03 articles (from Article 8 to Article 10)

- Chapter III PLACE OF RESIDENCE, including 09 articles (from Article 11 to Article 19)

- Chapter IV PERMANENT RESIDENCE REGISTRATION, including 7 articles (from Article 20 to Article 26)

- Chapter V TEMPORARY RESIDENCE REGISTRATION, STAY NOTIFICATION AND TEMPORARY ABSENCE DECLARATION, including 05 articles (from Article 27 to Article 31)

- Chapter VI RESPONSIBILITY FOR RESIDENCE MANAGEMENT, including 05 articles (from Article 32 to Article 36)

- Chapter VII IMPLEMENTATION CLAUSE, including 02 articles (Article 37 and Article 38).

Up to now, there has not been any information, documents or drafts on the issuance of the latest Residence Law to replace the Law on Residence 2020.

What are the procedures for confirming residency information in Vietnam in 2024?

The procedure for confirming residency information is outlined in Decision 320/QD-BCA of 2024 as follows:

Implementation sequence:

- Step 1: Individuals and organizations prepare the required documents in accordance with the law.

- Step 2: Individuals and organizations submit the documents to the local police at the commune level.

- Step 3: Upon receiving the documents for confirming residency information, the registration authority checks the legality and content of the documents:

+ If the documents are complete and valid, the authority accepts the documents and issues a Receipt for Document Submission and appoints a date to return the results (according to Form CT04 issued along with Circular 66/2023/TT-BCA) to the registrant.

+ If the documents meet the requirements but are incomplete, the authority provides guidance on how to supplement and complete the documents and issues a Supplementary Guidance Receipt (according to Form CT05 issued along with Circular 66/2023/TT-BCA) to the registrant.

+ If the documents do not meet the requirements, the authority rejects them and issues a Receipt for Rejection and Resolution of Documents (according to Form CT06 issued along with Circular 66/2023/TT-BCA) to the registrant.

- Step 4: Based on the appointment date on the Receipt for Document Submission and the appointment to return results, the registrant receives the notification of the results of the residency registration procedure (if any).

Implementation method:

- Submit the documents directly to the local police at the commune level, regardless of the place of residence of the individual.

- Submit the documents online through online public service portals such as the National Public Service Portal, the Ministry of Public Security's Public Service Portal, the VNeID application, or other online public service providers as prescribed by law.

Document submission time:

During business hours from Monday to Friday and Saturday mornings (excluding public holidays and festivals as prescribed by law).

Processing time:

From the date of receiving valid documents, the registration authority is responsible for issuing the confirmation of residency information to the individual within a maximum of 1/2 working day for cases where the information is available in the national population database and within 03 working days for cases where the information is not available in the national population database and the residency database needs verification. In case of refusing to issue the confirmation of residency information, a written response with specific reasons must be provided.

Results of administrative procedure implementation:

- In cases where the documents are valid and meet the requirements, the registration authority issues the confirmation of residency information (according to Form CT07 issued along with Circular 66/2023/TT-BCA).

- In cases of refusal to issue the confirmation of residency information, a written response with specific reasons must be provided (according to Form CT06 issued along with Circular 66/2023/TT-BCA).
