On April 12, 2024, the Ministry of Labor, Invalids and Social Affairs issued Notification 1570/TB-BLDTBXH in 2024 on proposed swap of working days during the Reunification Day (April 30th) and international Workers' Day (May 1st) holiday of 2024 for officials, public employees and employees of State administrative agencies, public service providers and enterprises.
Pursuant to the directive of the Government Office proposing swap of working days during the Reunification Day (April 30) and International Workers' Day (May 1) holiday of 2024, the Ministry of Labor, War Invalid and Social Affairs hereby notifies State administrative agencies, public service providers and enterprises of the swap of working days as follows
Officials, public employees and employees of State administrative agencies and public service providers (hereinafter referred to as "officials and public employees") will have their working day of April 29th 2024 (Monday) swapped with May 4th 2024 (Saturday).
This means they will have 05 consecutive days off from April 27th 2024 (Saturday) to May 1st 2024 (Wednesday) for the Reunification Day and International Workers' Day holiday of 2024.
May 4th 2024 (Saturday) will be the compensatory working day.
Specifically, the latest holiday schedule for April 30th, 2024 is as follows:
Agencies and units that do not take automatic days-off on Saturday and Sunday every week shall arrange their own holiday schedules in accordance with regulations of law
Employers at enterprises are encouraged to apply the same holiday schedule to their employees as that applied to officials and public employees, provided their employees receive all the benefits as prescribed by law. Agreements that are more beneficial for employees are encouraged.

Vietnam: How to handle the case where employees take additional leave without acceptable excuses after April 30th?
Pursuant to the provisions of Article 36 of the 2019 Labor Code:
The right of an employer to unilaterally terminates the employment contract
1. An employer shall have the right to unilaterally terminate an employment contract in one of the following circumstances:
a) The employee repeatedly fails to perform his/her work according to the criteria for assessment of employees’ fulfillment of duties established by the employer. The criteria for assessment of employees’ fulfillment of duties shall be established by the employer with consideration taken of opinions offered by the representative organization of employees (if any);
b) The employee is sick or has an accident and remains unable to work after having received treatment for a period of 12 consecutive months in the case of an indefinite-term employment contract, for 06 consecutive months in the case of an employment contract with a fixed term of 12 – 36 months, or more than half the duration of the contract in case of an employment contract with a fixed term of less than 12 months.
Upon recovery, the employer may consider concluding another employment contract with the employee;
c) In the event of a natural disaster, fire, major epidemic, hostility, relocation or downsizing requested by a competent authority, the employer has to lay off employees after all possibilities have been exhausted;
d) The employee is not present at the workplace after the time limit specified in Article 31 of this Labor Code;
dd) The employee reaches the retirement age specified in Article 169 of this Labor Code, unless otherwise agreed by the parties;
e) The employee is not present at work without acceptable excuses for at least 05 consecutive working days;
g) The employee fails to provide truthful information during the conclusion of the employment contract in accordance with Clause 2 Article 16 of this Labor Code in a manner that affects the recruitment.
Thus, if employees fail to present at work without acceptable excuses for at least 05 consecutive working days, employers have the right to unilaterally terminate the employment contracts.

How much are salaries for employees working in Vietnam on April 30th - May 1st, 2024?
Pursuant to the provisions of Article 98 of the 2019 Labor Code, regulations on overtime pay, night work pay are as follows:
Overtime pay, night work pay
1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:
a) On normal days: at least 150%;
b) On weekly days off: at least 200%;
c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.
2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.
3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.
4. The Government shall elaborate this Article.
Therefore, employees who work on the holiday of April 30th - May 1st, 2024, will receive the following salary:
- Working during the day: At least 300% of the normal daily wage.
- Working overtime at night: At least 390% of the normal daily wage. (300% for holiday overtime + 30% for working at night + 20% multiplied by the wage for regular daytime work on holidays (300%) = 390%).
The overtime wage mentioned above does not include the holiday pay.
