4. A document vertifying civil status information of an individual as prescribed at Points a, b, c, Clause 1 of this Article has the same validity as civil status papers and is used to prove civil status information when the individual performs carry out administrative procedures or participate in other civil transactions as prescribed by law.

What is the current procedure for vertifying civil status information at the electronic civil status database management agency in Vietnam?

Pursuant to Decision 528/QD-BTP in 2023 announcing the revised and supplemented administrative procedures in the field of civil status under the management of the Ministry of Justice, issued on April 10, 2023.

Currently, the procedures for vertifying civil status information at the electronic civil status database management agency are carried out according to the provisions of subsection 1, Section C, Part II of the Appendix to Administrative Procedures issued together with Decision 528/QD-BTP in 2023.

Specifically:

Step 1: The person requesting the certification of civil status information submits the application for certification of civil status information at the single-window Department/Public Administration Center of the Agency managing the electronic civil status database; pay fees in accordance with the law

Step 2: The dossier-receiving officer at the single-window department is responsible for checking the accuracy, completeness, consistency and validity of the dossier.

- In case the application is complete and valid, the application will be received, has an appointment slip, returns the results to the requester, and at the same time transfers the dossier to civil status civil servants for handling.

After receiving the dossier, the dossier-receiving officer at the single-window department section digitizes and digitally signs the documents and records to handle administrative procedures that have been digitized according to regulations.

- In case the dossier is incomplete or invalid, a notice shall be sent to the person requesting the supplement or completion of the dossier.

- In case the person who requests for certification of civil status information fails to supplement or complete the dossier, he/she shall report it to the head of the single-window department section with a notice of refusal to handle the request for civil status information certification.

Step 3: Civil status officers verify the records.

- In case the dossier needs to be supplemented or completed or is not eligible for settlement and must be rejected, a notice of the status of the application shall be sent to the single-window department to notify the applicant;

- In case it is necessary to check, verify, clarify or due to other reasons, it is impossible to return the results on the scheduled time, the civil status officer shall make an apology slip and reschedule the return date and send it to the Ministry of Health to pay the person who asked for it.

In case verification is required, civil status officers shall report to the head of the agency managing the electronic civil status database in writing to request the police and other relevant agencies for verification. In case the verification results have no information or the information is inconsistent with the papers provided by the requester, the written certification of civil status information shall be refused.

For a request for certification of civil status information of an individual, if it is found that the civil status information of the individual has not changed, the civil status officer shall report to the Head not to issue a document certifying civil status information. which instructs the requester to carry out the procedures for issuance of a copy of the birth certificate or a copy of the relevant civil status extract, unless a competent agency or organization requests the issuance of a written certification to settle a related case. to the individual.

- If the application is found to be complete, valid and in accordance with regulations, the information in the electronic civil status database and the information requested for confirmation is correct, the civil status officer shall print the written confirmation of information. civil status records, submit them to the Head for signature, and send them to the single-window department to return the results to the requesters.

Step 4: The person who requests for certification of civil status information will receive the result as a written confirmation of civil status information.

Processing time: 03 days. In case of inspection and verification, the time limit may be extended but must not exceed 10 working days.
