How to correctly fill in the registration of amendment to content of security interest in land use rights or property on land in Vietnam?
On theform for registration of amendment to content of security interest in land use rights or property on land in Vietnam issued together with Decree 99/2022/ND-CP, small serial numbers will be noted above the letters.
Organizations and individuals, when registering to amend to content of security interest in land use rights or property on land, will base on these small ordinal numbers to fill in the form according to the instructions below:
(1) Issued together with Decree 99/2022/ND-CP dated November 30, 2022 of the Government. This registration request form also applies to the case where the recipient legally transfers the security property or the competent agency or person specified in Clause 3, Article 8 of Decree No. 99/2022/ND -CP only requires withdrawal of one or a number of security assets to remove registration for this asset.
(2) Enter the correct name of the competent registrar. A Registration Request Form is only sent to one registrar.
(3) In case there are many people, each person must be declared according to the information shown on this registration request form. In case of securing the performance of obligations related to property belonging to a private enterprise, the applicant for registration shall be declared according to the provisions of Clause 9 Article 8 of Decree 99/2022/ND-CP.
(4) Declare more titles, practice certificate number, issuing agency and date, month and year of certificate issuance.
(5) In this case, check both the branch box of the legal entity, the representative and the box of the Guarantor or the box that the secured party is a legal entity that registers through the branch or the representative.
(6) Declare according to the information shown on the identity card, citizen identification for Vietnamese citizens; Military ID card for people who are working in the army and do not have a people's identity card or citizen identity card; Passports for foreign citizens; Permanent residence card for stateless people.
(7) Declare according to the information shown on the certificate of tax registration (applicable also in the case of declaration for branches).
(8) Applicable in case of registration of changes as prescribed at Point b, Clause 1, Article 18 of Decree 99/2022/ND-CP.
(9) For contracts, contract amendments and supplements, documents on transfer of the right to collect debt, transfer of obligations: Declare the date of notarization or authentication (applicable to contracts, documents approved notarization, authentication); effective date as agreed in the contract, document (applicable to contracts, documents not notarized or authenticated); the date of signing the contract, the document (applicable to the contract, the document is not notarized or authenticated and the parties do not have an agreement on the effective date in the contract or document). For other documents proving the grounds for change: Declare the effective date shown in the document or the date of signing of the document if the document does not show the effective date.
(10) In case of registration of changes to supplement secured obligations as prescribed at Point g, Clause 1, Article 18 of Decree 99/2022/ND-CP, the declared content is additional information about the contract or document containing the content of an agreement on additional secured obligations shown in Section 2 of this registration request form.
(11) Fully declare the required documents in the registration dossier according to the provisions of Decree 99/2022/ND-CP.
(12) The applicant for registration of changes as prescribed in Clauses 2 and 3, Article 8 of Decree 99/2022/ND-CP.
What should be kept in mind when filling in the registration of amendment to content of security interest in land use rights or property on land in Vietnam?
In the Appendix issued together with Decree 99/2022/ND-CP, there are instructions on a number of points to note when organizations and individuals fill in information in the registration of amendment to content of security interest in land use rights or property on land as follows:
- Declared contents must be truthful, complete and accurate.
- For the selected declaration, mark (X) in the corresponding box selected.
- Information declared, related content in the Request Form can be displayed on many pages. In this case, the pages must be numbered and the person requesting the registration must sign each page.
- In case of registration of changes due to the addition of the guarantor, the secured party or the addition of security assets, the declaration of the subject to be supplemented shall be made according to the corresponding information shown on Form No. 01a attached to the Appendix issued together with Decree 99/2022/ND-CP.
Decree 99/2022/ND-CP will take effect from January 15, 2022.
