"Article 5. Postponement and exemption from conscription
The postponement and exemption from conscription during peacetime are implemented according to the provisions of Article 41 of the 2015 Military Service Law, as follows:
1. postponement from conscription applies to the following citizens:
a) Those not healthy enough for military service as concluded by the health examination council.
b) The sole laborer directly supporting family members who are unable to work or are not yet of working age; families suffering severe damage in terms of person and property caused by accidents, natural disasters, or dangerous epidemics as confirmed by the commune-level People's Committee.
c) A child of a war invalid, or someone affected by Agent Orange who has a labor capacity reduction from 61% to 80%.
d) Having a sibling who is a non-commissioned officer or soldier on active duty; a non-commissioned officer or soldier fulfilling obligations in the People's Public Security.
đ) A person who has migrated or resettled within the first 3 years to particularly difficult communes under the State's socio-economic development project as decided by the provincial People's Committee or higher authorities.
e) Officials and public employees, young volunteers mobilized to work in areas with extremely difficult socio-economic conditions as prescribed by law.
g) Currently studying at a primary education institution; pursuing a regular university degree at a higher education institution, or pursuing a regular college degree at a vocational education institution during one training course of an educational level."
Therefore, the above-mentioned subjects are eligible for a postponement from conscription according to regulations.

How to apply for a postponement from conscription conformable?
According to the provisions of Clause 1 Article 42 of the 2015 Military Service Law, citizens perform the procedure for a postponement from conscription as follows:
- When there is a call to enlist, citizens submit the application for a postponement from conscription at the commune-level People's Committee.
- The commune-level People's Committee will review, register, manage the citizens eligible for a postponement, and propose the district-level People's Committee to issue a decision on the postponement from conscription.
- The chairman of the district-level People's Committee will issue a decision on the postponement from conscription if the application is valid. If not valid, the citizen must still fulfill the military service.
- Based on the decision of the chairman of the district-level People's Committee, the commune-level People's Committee will publicly list the citizens eligible for a postponement from conscription at the headquarters of the commune-level People's Committee, offices, and organizations for 20 days.
Thus, the chairman of the district-level People's Committee decides on the postponement and exemption from conscription for citizens.
