In the coming time, enterprises applying for issuance or reissuance of a certificate of endorsement for seafarer recruitment and placement service provider must use form No. 04 in the Appendix issued together with Decree 69/2022/ND-CP as follows:

Amend the regulation on the application for issuance of certificate of endorsement for seafarer recruitment and placement service provider in Vietnam?
Pursuant to Clause 1, Article 3 of Decree 69/2022/ND-CP as follows:
Amend and supplement a number of articles of the Government's Decree No. 29/2017/ND-CP dated March 20, 2017 on conditions for seafarer's training facilities and seafarer's recruitment and placement service providers
1. Amend and supplement Clause 1, Article 13 as follows:
"1. A seafarer recruitment and placement service provider shall submit 01 set of application directly or via the postal system or via the online public service system or by other suitable methods to the Vietnam Maritime Administration. The application includes:
a) An application form using form No. 4 prescribed in the Appendix issued together with;
b) A certified copy or a copy enclosed with the original for comparison or an electronic copy or an electronic copy from the master book or a certified electronic copy from the original of the license to offer guest worker program or the license to supply or outsource seafarers in the form of labor supply or outsourcing, or guest worker program as prescribed by law;
c) A certified copy or a copy enclosed with the original for comparison or an electronic copy or an electronic copy from the master book or a certified electronic copy from the original the certification of quality management system in accordance with ISO 9001 and paragraph 1.4 of MLC 2006 on seafarer recruitment and placement service.
Accordingly, in the coming time, enterprises must prepare 01 application, including all the above documents.
Amend the regulation on the application for reissuing the Certificate of eligibility for seaport operations in Vietnam?
Pursuant to Clause 2, Article 11 of Decree 37/2017/ND-CP stipulating the application for reissuing the Certificate of eligibility for seaport operations as follows:
Procedures for the reissuance of the Certificate

2. The applicant shall submit 01 set of application for the reissuance of the Certificate to the Vietnam Maritime Department directly or in another appropriate manner. Such application includes a completed application form according to the Specimen No. 1 in the Appendix of this Decree and other documents related to the change of the Certificate (if any).
Curently, enterprises applying for re-issuance of the certificate of eligibility for seaport operations must submit applications to the Vietnam Maritime Administration.
The appliction will include documents such as the declaration form for re-issuance of the certificate and documents related to the change in the content of the issued certificate.
The notable content that according to this regulation, enterprises are only allowed to apply directly to the Vietnam Maritime Administration when there is a request for re-issuance of the certificate of eligibility for seaport operations.
However, according to Clause 2, Article 2 of Decree 69/2022/ND-CP, the application for re-grant of the certificate of eligibility for seaport operations is changed and supplemented as follows:
Amend and supplement a number of articles of the Government's Decree No. 37/2017/ND-CP dated April 4, 2017 on the requirements for seaport operations

2. Amend and supplement Clause 2, Article 11 as follows:
“2. A port-operating enterprise shall submit 01 set of application to the Vietnam Maritime Department directly, via the postal system or the online public service system or under any other appropriate methods. The application for the Certificate includes:
a) A declaration form for re-issuance of the certificate according to the Specimen No. 1 in the Appendix of this Decree;
b) Certified copy or copy with original for comparison or electronic copy or electronic copy from the original or certified electronic copy from the original business registration certificate (in case of change of information about the enterprise);
c) The original or an electronic copy or an electronic copy from the original or an electronic copy certified from the original plan for seaport operations of the port-operating enterprise (in case of changing the contents of the location or scale and function of the seaport)."
Accordingly, in the coming time, except for sending a declaration form for reissuance of the certificate to the Vietnam Maritime Administration, enterprises must also enclose a certified copy of the business registration certificate (in case of change of information about the enterprise) and the original or electronic copy of plans for seaport operations.
In addition, the above regulations have also expanded the method of submitting applications for reissuance of certificates of eligibility for seaport operations. Specifically, there will be 4 methods of submitting applications instead of just being submitted at the Vietnam Maritime Administration as at present, those methods are as follows:
- Direct
- Via postal system
- Through the public service system
- Other appropriate methods
Decree 69/2022/ND-CP will take effect from October 30, 2022.
