What is the implementation of the issuance of a license for the export of fireworks and explosive pyrotechnic compositions at the National Police Department of Social Affairs in Vietnam?
Pursuant to Article 10 of Decree 137/2020/ND-CP, subsection 32 Section D Part II Administrative procedures issued together with Decision 3191/QD-BCA in 2022. The issuance of explosive export licenses at the National Police Department of Social Affairs shall be carried out according to the following procedures:
- Order of execution:
+ Step 1: Central agencies, organizations and enterprises wishing to issue explosive export licenses shall submit dossiers to the Police Department on Administrative Management of Social Order - Ministry of Public Security of Vietnam during office hours on working days of the week, through the online public service portal or via the postal service.
+ Step 2: The receiving officer checks the validity and composition of the dossier.
If the dossier meets the conditions and procedures, it shall receive the dossier, deliver the receipt or notify on the online Public Service Portal to the person assigned by the agency, organization or enterprise.
In case the dossier is eligible but lacks procedures or incomplete and accurate declaration, the written instructions or notice on the online Public Service Portal clearly state the procedures and contents to be supplemented and declared.
In case the application is not eligible, the dossier shall not be received and a written response or notice on the Online Public Service Portal stating the reasons for not receiving the application.
+ Step 3: Based on the appointment date on the receipt or notice on the online public service portal, agencies, organizations and enterprises that are granted explosive export licenses to receive explosive export licenses or receive them through the online public service portal, via postal services.
- How to do it:
+ Submit documents directly at the headquarters of the Police Department on Administrative Management of Social Order - Ministry of Public Security of Vietnam;
+ Apply via postal service;
+ Apply online via the National Public Service Portal or the Public Service Portal of the Ministry of Public Security of Vietnam.
- Time limit for settlement: 05 working days.
- Subjects of administrative procedures: Organizations and enterprises.
- Agency carrying out administrative procedures: Department of Police administrative management of social order - Ministry of Public Security of Vietnam.
- Results of administrative procedures: License for export of fireworks and explosive pyrotechnic compositions.
- Fee (if any): 150,000 VND/01 license.

What does the application for an explosive export license in Vietnam include?
Dossiers of application for explosive export licenses shall be made according to Clause 4 Article 10 of Decree 137/2020/ND-CP, subsection 32 Section D Part II Administrative procedures issued together with Decision 3191/QD-BCA in 2022.
Specifically, it includes the following:
- A written request specifying the type and quantity of fireworks and explosive pyrotechnic compositions and means of transport;
- A copy of the establishment decision or a copy of the Certificate of Business Registration;
- Referral;
- A copy of the citizen's identity card or identity card or passport or military identification card.
Number of applications: 01 (one) set.
Can organizations and enterprises exporting fireworks and explosive pyrotechnic compositions transport fireworks and explosive pyrotechnic compositions in Vietnam?
Pursuant to the provisions of Clause 1, Article 13 of Decree 137/2020/ND-CP as follows:
Article 13. Issuance of transport permit for fireworks and explosive pyrotechnic composition
1. Organizations and enterprises affiliated to Ministry of National Defense assigned by Prime Minister of Vietnam to conduct research, manufacture, import, export or supply fireworks may transport fireworks and explosive pyrotechnic composition.
According to regulations, organizations and enterprises under the Ministry of National Defense of Vietnam assigned by the Prime Minister of Vietnam to export fireworks and explosive pyrotechnic compositions may transport explosives.
Accordingly, the transportation of explosives shall comply with the following provisions:
- Have a transport permit or transport order from the competent authority;
- Persons and specialized means of transporting fireworks and explosive pyrotechnic compositions must meet the requirements for transporting industrial explosive materials as prescribed;
- Use specialized means to ensure conditions for transporting fireworks and explosive pyrotechnic compositions and ensure safety, fire prevention and fighting, environmental protection;
- Do not carry explosives and persons in the same vehicle, except those responsible for transporting them;
- Do not stop and park vehicles transporting fireworks and explosive pyrotechnic compositions in crowded places, residential areas, near petrol stations, where important works on defense, security, economy, culture and diplomacy are located.
In case of needing to stay overnight or due to an incident, it is necessary to immediately notify the nearest military agency or police agency to coordinate protection when necessary and have a plan to ensure safety, prevent fire, explosion or damage.
