What is the responsibility of the Customs officer to confirm the Imported Wood List of Vietnam?

According to the provisions of Article 27 of Decree No. 102/2020/ND-CP on Vietnam's legal timber assurance system, it is stipulated:

“Article 27. Responsibilities of forest protection authorities, FLEGT licensing authorities, customs authorities, relevant organizations and individuals
3. Customs authorities shall:
a) Cooperate with forest protection authorities and relevant authorities in verifying legality of import and export shipments of timber;
b) Inspect and certify packing lists of imported timber.”

In Official Dispatch 7131/TCHQ-GSQL in 2020, implementing Decree 102/2020/ND-CP issued by the General Department of Customs, stipulating the certification of Customs officers on the List of imported timber, specifically:

- If the detailed list (Log List or Packing List) made by the exporter has information consistent with the List of imported timber made by the timber owner according to Form No. 01 or Form No. 02 of Appendix I, the customs declarant Customs authorities write “according to the attached detailed list” and submit it to the customs office when carrying out import procedures.

- The certification of the customs authority on the List of imported timber is done by the customs officer who receives and checks the details of the dossier (for the golden channel dossier) or the customs officer who physically inspects the goods (for the red channel declaration) and enclosed with the customs dossier. In case there is a difference between the actual inspection results and the declaration of the customs declarant, the customs officer shall check the actual goods and write "difference according to the customs declaration" before confirming.

What is the form of declaration of origin of imported wood in 2022 in Vietnam?

In Official Dispatch 2380/TCHQ-GSQL in 2022 implementing Decree 102/2020/ND-CP issued by the General Department of Customs, regulations on the declaration of specific imported wood origin that according to the provisions of Decree No. 102 /2020/ND-CP, the owner of the imported timber is the one who signs, writes his/her full name and stamps (if any) on Form No. 03 issued together with Decree No. 102/2020/ND-CP. Accordingly, it is requested that the units guide businesses to strictly comply with the regulations on the Declaration of Imported Timber Origin (Form 03) and only accept the Declaration of Imported Wood Origin signed by the imported timber owner, stamp (if any).
