On May 25, 2023, the Ministry of Transport of Vietnam issued Decision No. 636/QD-BGTVT in 2023 on the Code of Conduct for office holders under the Ministry of Transport of Vietnam.

According to that, office holders in administrative agencies, public service providers and enterprises under the Ministry of Transport of Vietnam are determined according to Clause 2, Article 1 of the Code of Conduct issued together with Decision No. 636/QD-BGTVT in 2023 is as follows:

2. Subjects of application: office holders in administrative agencies, non-business units and enterprises under the Ministry of Transport of Vietnam (hereinafter referred to as "office holders"), include:
a) Cadres, civil servants and public employees;
b) The representative of the state capital share in the enterprise;
c) Persons holding managerial titles and positions in the enterprise (including: Chairman of the Board of Members; President of the company (for companies without a Board of Members); Member of the Board of Members; General Director; Director; Deputy General Director; Deputy Director; Chief Accountant; Controller at enterprises in which 100% charter capital is held by the State;
d) Other persons assigned to perform tasks or official duties and have powers while performing such tasks or official duties.

Pursuant to Article 3 of the Code of Conduct issued together with Decision No. 636/QD-BGTVT in 2023 as follows:

General code of conduct
1. Strictly implement the code of conduct specified in Section 3, Chapter II of the 2018 Law on Anti-corruption and Chapter IV of Decree No. 59/2019/ND-CP dated July 1, 2019 of the Government detailing a number of articles and measures to implement the Law on Anti-corruption.
2. Exercising the responsibility to set an example according to Regulation No. 101-QD/TW dated June 7, 2012 of the Secretariat of the Party Central Committee on the responsibility to set an example of cadres and party members, especially key leaders of the Party grant; Regulation No. 08-QD/TW dated October 25, 2018 of the Central Committee stipulates the responsibilities of cadres and party members to set an example, first of all a member of the Politburo, a member of the Secretariat, a member of the Central Committee; Resolution No. 06-NQ/DUK dated January 25, 2017 of the Party Committees of Central Agencies on strengthening the vanguard and exemplary character of cadres and party members, especially the heads of committees, agencies and units in the current situation and Decision No. 140-QD/DU dated April 19, 2022 of the Party Committee of the Ministry of Transport of Vietnam, promulgating the ethical standards of cadres and party members of the Ministry of Transport according to Ho Chi Minh's ideology, morality and style.
3. Implement standards of conduct in the performance of duties and public duties as prescribed by law; standards of conduct in social relations have been stipulated in the Decision No. 1807/QD-BGTVT dated October 2, 2019 of the Minister of Transport on the Implementation Plan of the Project on Civil Service Culture; Decision No. 2736/QD-BGTVT dated October 31, 2012 of the Minister of Transport providing for the implementation of the regime of responsibility of civil servants under the Ministry of Transport of Vietnam in performing their duties and public duties.

Thus, office holders in administrative agencies, non-business units and enterprises under the Ministry of Transport of Vietnam have general codes of conduct according to the above provisions.

What is the dress code and work style for office holders under the Ministry of Transport of Vietnam?

Pursuant to the provisions of Article 4 of the Code of Conduct issued together with Decision No. 636/QD-BGTVT in 2023, the dress and work style for office holders under the Ministry of Transport of Vietnam are prescribed as follows:

- When performing their duties and tasks, office holders must dress neatly and politely, wear shoes or sandals with back straps.

+ Costumes must be suitable to the nature of work, the characteristics of the industry or agency or unit, and fine customs and traditions.

+ For agencies and units that have their own uniforms, they must comply with separate regulations.

- Must wear official ID card (or name tag, badge, title card as prescribed) throughout the working time, on official duty.

- Serious posture, manners and gestures; welcoming attitude, humility, respect for the communicator; use standard, clear, coherent language.

- Arrange the workplace in a neat and orderly manner; do not display or store depraved images and cultural content, documents against the Party and State.

- Strictly abide by regulations on working time and attending meetings; arrange and use time to work scientifically and effectively.

+ During working hours, do not leave the agency, unit or working position without a legitimate reason or without the consent of the competent authority;

+ Do not do private work, listen to music, play video games and use personal entertainment devices.

- Smoking in the right place. It is strictly forbidden to use alcoholic beverages right before and during working hours, lunch breaks on working days (unless approved by leaders of agencies, units and enterprises on public holidays, diplomatic reception); strictly comply with the "No booze if you are driving" rule.
