Pursuant to Clause 1, Article 23 of Circular 26/2022/TT-BGTVT stipulates as follows:
Tasks of the advisory body
1. For Detailed Outline Approval
a) In case the agency submitting the detailed outline is the Department:
Within 15 working days from the date of receipt of the written submission of the draft detailed outline, the advisory body shall submit it for consideration, study and submit to the Deputy Minister in charge of signing a document approving or disapproving the outline. detail. In case of disapproval, the reasons and solutions must be clearly stated;
b) In case the agency in charge of drafting is concurrently an advisory body to submit: the consulting agency shall submit the draft detailed outline for submission to the Deputy Minister in charge of signing the written approval within the time limit specified in the Program;
c) The form of written approval of the detailed outline is specified in Appendix II issued with this Circular.
According to the above provisions, within 15 working days from the date the consulting agency receives the written submission of detailed outline of the legislative document from the Ministry of Transport, it must study, consider and submit it to the deputy minister in charge of signing the document approving the detailed outline. In case of disapproval, the reasons and solutions must be clearly stated.
In case the agency in charge of drafting is concurrently an advisory agency, submit it: the consulting agency shall submit the draft detailed outline and submit it to the Deputy Minister in charge of signing the approval document within the time limit specified in the document development program of the Ministry of Transport.
What is the application file for registration of the program on formulation of legislative documents of the Ministry of Transport of Vietnam?
Pursuant to Article 14 of Circular 26/2022/TT-BGTVT stipulating as follows:
Program registration documents
1. A dossier of registration for formulation of a legislative document includes:
a) A written request for formulation of a legislative document, clearly stating the legal grounds and the necessity for promulgation; construction purposes and viewpoints; scope of regulation, subjects of application; objectives, main content of the document; basic policies and solutions for implementation; estimated resources and conditions for the implementation; estimated time to submit to the Government, the Prime Minister and the Minister of Transport;
b) A report summarizing the implementation of the law or assessing the status of social relations related to the request for formulation of legislative documents;
c) Administrative procedures in cases where administrative procedures are assigned by law;
d) Outline of draft legislative documents;
dd) The proposed drafting agency, the consulting agency to submit, the coordinating agency, the deputy minister in charge, the issuing agency, the time for submitting the detailed outline, the time for submitting the draft document (according to the draft document);
e) Other documents (if any).
2. For documents requiring formulation of a legislative document as prescribed in Article 5 of this Circular, after the Government's resolution ratifies the request for formulation of legislative documents, the agency in charge of advising shall submit the registration to the Legal Department according to the provisions of Point dd, Clause 1 of this Article to update the task of developing documents into the Program.
Accordingly, the application file for registration of the program on formulation of legislative documents of the Ministry of Transport includes the following documents:
- A written request for the formulation of a legislative document, clearly stating the legal grounds and the necessity for promulgation; construction purposes and viewpoints; scope of regulation, subjects of application; objectives, main content of the document; basic policies and solutions for implementation; estimated resources and conditions for the implementation; estimated time to submit to the Government, the Prime Minister and the Minister of Transport;
- A report summarizing the implementation of the law or assessing the status of social relations related to the request for the formulation of legislative documents;
- Administrative procedures in cases where they are assigned by law to prescribe administrative procedures;
- Outline of draft legislative documents;
- The proposed drafting agency, the consulting agency to submit, the coordinating agency, the deputy minister in charge, the promulgating agency, the time for submitting the detailed outline, the time for submitting the draft document (depending on each level);
