What is the Form No. 14-HSB for lump-sum social insurance benefits in Vietnam? What is the application for lump-sum social insurance benefits?

The form of application form for lump-sum social insurance benefits (Form 14-HSB) is specified in the Appendix issued together with Decision 166/QD-BHXH dated January 31, 2019 of the General Director of Vietnam Social Insurance).

A dossier of application for lump-sum social insurance benefits includes the documents specified at Point a, Section 1.2.3, Clause 1, Article 6, attached to Decision 166/QD-BHXH in 2019 on application for lump-sum social insurance benefits.

- Social insurance book.

- The application form 14-HSB.

- If a person moves to reside overseas, the applications must also include the copy of the affirmation of renunciation of Vietnamese nationality or certified or notarized Vietnamese translation of one of the following documents:

+ Passport issued by a foreign authority.

+ Visa issued by a foreign authority, certifying legal immigration for permanent residence abroad.

+ Document certifying the application for foreign citizenship; certification or card of permanent or temporary residence for a period of at least 05 years issued by a foreign authority.

- Where a person contracts a life-threatening disease such as cancer, polio, ascites, leprosy, severe tuberculosis or a HIV-positive person who develops AIDS, the application must also include the medical record extract/summary certifying the patient's inability to take care of himself/herself; if a person contracts another disease, the application shall include the report on assessment of work capacity reduction given by the medical assessment council to certify the patient’s work capacity reduced by 81% or more severe and the patient's inability to take care of himself/herself.

- In case of payment of medical assessment charges, invoices/receipts and list of medically assessed contents given by health facility must be submitted.

- The Statement Form No. 04B-HBKV (promulgated together with the Circular No. 181/2016/TT-BQP) of the person who served in the army before January 01, 2007 in area where region-base benefit is granted.

What is the formula for calculating lump-sum social insurance allowance in Vietnam?

Clause 2, Article 60 of the Law on Social Insurance 2014 prescribes the formula for calculating lump-sum social insurance allowance as follows:

2. The lump-sum social insurance allowance shall be calculated based on the number of years of social insurance premium payment; for each year of payment it must equal:
a/ 1.5 times the average monthly salary on which social insurance premiums are based, for the years of payment prior to 2014;
b/ 2 times the average monthly salary on which social insurance premiums are based for the years of payment since 2014;
c/ For a period of social insurance premium payment of under 1 year, the social insurance allowance must equal the paid premium amount but not exceed 2 times the average monthly salary on which social insurance premiums are based.

In addition, in Clause 2, Article 19 of Circular 59/2015/TT-BLDTBXH, additionally on the calculation of the lump-sum social insurance allowance for employees who have paid social insurance premiums for less than one year:

Lump-sum social insurance allowance
1. The lump-sum social insurance is done under the provisions in Article 60 of the Law on social insurance, the Resolution No. 93/2015/QH13 dated 22/06/2015 of the National Assembly on implementing the policy on entitlement to lump-sum social insurance for the employees and Article 8 of Decree No. 115/2015/ND-CP.
The average monthly salary for social insurance payment as a basis for calculating the lump-sum social insurance shall comply with the provisions in Article 62 of the Law on social insurance, Article 9 of Decree No. 115/2015/ND-CP and Article 20 of this Circular. Where the time of social insurance payment under the salary stipulated by the State still misses the number of last years specified in Clause 1, Article 20 of this Circular, the average of monthly salary of the months of social insurance payment.
2. The rate of entitlement to lump-sum social insurance of the employees having the time of social insurance payment of under 01 year is equal to 22% of the rates of monthly salary of social insurance payment, the maximum rate is equal to 02 months of the average monthly salary of social insurance payment.

Accordingly, the calculation of lump-sum social insurance is implemented as follows:

Lump-sum social insurance benefit = {(1.5 x number of years participating in social insurance before 2014) + (2 x number of years participating in social insurance from 2014)} x Mbqtl

* In case of paying social insurance premium for less than 01 year, the following formula shall be used:

Lump-sum social insurance benefit = 22% x number of months x monthly salary

However, the maximum level is equal to 02 months of the average monthly salary on which social insurance premiums are based.

How long does it take to process a lump-sum social insurance allowance in Vietnam?

Article 110 of the Law on Social Insurance 2014 provides for the Settlement of pension or lump-sum social insurance allowance as follows:

Settlement of pension or lump-sum social insurance allowance
1. Within 30 days by the time an employee enjoys pension, the employer shall submit a dossier specified in Clause 1, Article 108 of this Law to the social insurance agency.
2. Within 30 days by the time an employee enjoys pension, employees having their period of social insurance premium payment reserved or employees covered by voluntary social insurance shall submit a dossier specified in Clause 2, Article 108 of this Law to the social insurance agency.
3. Within 30 days by the time an employee becomes eligible and requests payment of lump-sum social insurance allowance, he/she shall submit a dossier specified in Article 109 of this Law to the social insurance agency.
4. Within 20 days after receiving a complete and valid dossier, for to-be- pensioners, or within 10 days after receiving a complete and valid dossier, for persons to enjoy a lump-sum social insurance allowance, the social insurance agency shall settle the enjoyment of pension or lump-sum allowance and make payment to employees; or issue a written reply clearly stating the reason for its refusal to settle such enjoyment.

Thus, according to the above provisions, a request for a lump-sum social insurance benefit shall be settled within the following time frame:

Within 30 days by the time an employee enjoys pension, the employer shall submit a dossier.

Within 10 days after receiving a complete and valid dossier, for persons to enjoy a lump-sum social insurance allowance, the social insurance agency shall settle the enjoyment of pension or lump-sum allowance and make payment to employees; or issue a written reply clearly stating the reason for its refusal to settle such enjoyment.
