What are the conditions for drivers of vehicles to join in traffic?

Pursuant to Article 58 of the Law on Road Traffic 2008 of Vietnam on conditions for drivers of vehicles to join in traffic:

“Article 58. Conditions for drivers of vehicles to join in traffic
1. Drivers of vehicles to join in traffic must be of the age and in good health as prescribed in Article 60 of this Law, and proper driver licenses for the types of vehicle they are permitted to operate, which are granted by competent state agencies.
Learner drivers, when joining in traffic, shall practice driving on driving practice vehicles and have their driving supported by driving instructors.
2. When operating a vehicle, the driver shall carry the following papers:
a/ Vehicle registration paper;
b/ Driver license, for motor vehicle operators defined in Article 59 of this Law;
c/ Technical safety and environmental protection inspection certificate, for motor vehicles prescribed in Article 55 of this Law;
d/ Motor vehicle owner civil liability insurance certificate.”

Pursuant to Article 58 of the Law on Road Traffic 2008 of Vietnam on traffic in road tunnels:

“Article 27. Traffic in road tunnels
Operators of vehicles traveling in road tunnels, apart from complying with traffic rules provided in this Law, shall also observe the following provisions:
1. Motor vehicles and special-use vehicles must switch on their lamps and rudimentary vehicles must switch on their lamps or carry luminous signal devices.”

Thus, according to the above regulation, when traveling in road tunnels, operators of motor vehicles and special-use vehicles must switch on their lamps and rudimentary vehicles must switch on their lamps or carry luminous signal devices.

If operators of vehicles traveling in road tunnels don't switch on their lamps, the penalties imposed upon them are stipulated in Point r Clause 3 and Point b Clause 11 Article 5 of Decree 100/2019/ND-CP of Vietnam:

“Article 5. Penalties imposed upon operators of cars and car-like vehicles violating traffic rules
3. A fine ranging from VND 800,000 to VND 1,000,000 shall be imposed upon a vehicle operator who commits any of the following violations:
m) Failure to reduce speed and yield when joining the traffic from an alley or when moving from a small road to a major road;
n) Failure to yield to vehicles in the emergency lane or on the major road at an intersection;
o) Reversing the vehicle on a one-way road or a road where a “Cấm đi ngược chiều” (No entry) sign is erected, where stopping is prohibited, at a crosswalk, at an intersection with another road or railway, where view is blocked; reversing the vehicle without observation or without signals; except for cases specified in Point a Clause 8 of this Article;
p) Failure to fasten seat belt while operating the vehicle;
q) Carrying passengers who fail to fasten the seat belts (if available) while the vehicle is running;
r) Failure to turn on low beam while operating the vehicle in a road tunnel;
s) Operating the vehicle at a lower speed than the lowest permissible speed.
10. Apart from incurring fines, the violating operator shall also incur the following additional penalties:
c) The violation(s) specified in Point a Clause 6; Points a and b Clause 7; Points a, b, c and d Clause 8 of this Article shall lead to suspension of driving license from 2 months to 4 months; repetition or multiple violations of offence(s) specified in Points a, b, c and d Claus 8 of this Article shall lead to suspension of driving license from 3 months to 5 months and confiscation of vehicle. Committing violation(s) specified in Points a, g, h, k, l, m and q of Clause 1; Points b, d, e, g, l and m of Clause 2; Points b, c, k and m of Clause 3; Points dd, e, g and h of Clause 4 of this Article and causing accidents shall lead to suspension of driving license from 2 months to 4 months.”

According to the above regulations, if you fail to turn on low beam while operating the vehicle in a road tunnel, you will be fined from VND 800,000 to VND 1,000,000. In addition, you will also incur the additional penalty which is suspension of driving license from 2 months to 4 months in case of causing accidents.
