What is the current organizational structure of the Copyright Office of Vietnam?
On April 11, 2023, the Vietnam Ministry of Culture, Sports, and Tourism issued Decision 912/QÐ-BVHTTDL 2023 regulating the functions, tasks, powers, and organizational structure of the Copyright Office of Vietnam.
In Article 3 of Decision 912/QD-BVHTTDL in 2023, there are the following provisions:
Organizational structure
1. The Director and the Deputy Directors.
2. Specialized and professional departments:
a) Office of the Copyright Office of Vietnam;
b/ The Department of Management and International Cooperation on copyright and related rights;
c/ The Department of Management of the Cultural Industry;
d) Copyright and related rights registration office.
3. Affiliated public service providers:
Center for expertise, information and transfer of copyright and related rights.
The Director of the Copyright Office of Vietnam shall be responsible before the Minister and before law for the performance of assigned tasks and powers; be responsible for prescribing functions, tasks and organizational structure of affiliated specialized and professional departments and public service providers; arrange civil servants, public employees and employees according to the structure of titles and professional standards for affiliated specialized and professional departments and public service providers; formulate and promulgate regulations on organization and operation of the Copyright Office of Vietnam.
Thus, the current organizational structure of the Copyright Office of Vietnam includes:
- The Director and the Deputy Directors
- Specialized and professional departments
- Affiliated public service providers

Pursuant to the provisions of Article 1 of Decision 912/QD-BVHTTDL in 2023 on the position and functions of the Copyright Office of Vietnam as follows:
Position and functions
The Copyright Office of Vietnam is an administrative organization affiliated to the Ministry of Culture, Sports and Tourism, performing the function of advising and assisting the Minister in state management and organization of law enforcement on copyright and related rights protection and cultural industry nationwide; managing public services in the copyright and related rights protection in accordance with the provisions of law.
The Copyright Office of Vietnam has its own seal, has an account at the State Treasury.
Thus, according to the above regulations, the Copyright Office of Vietnam is an administrative organization affiliated to the Ministry of Culture, Sports and Tourism and has its own seal.
How many duties and powers does the Copyright Office of Vietnam have?
Pursuant to the provisions of Article 2 of Decision 912/QD-BVHTTDL in 2023, the Copyright Office of Vietnam has the following 23 duties and powers:
- Submit to the Minister draft legal documents, strategies, mechanisms, policies, decentralization of state management, plans, programs, projects and schemes.
- Guide and implement the supply, cooperation, order, use and guarantee of copyright.
- Organize the implementation of measures for the development of cultural industries; protect the legitimate rights and interests of organizations, individuals, the State and society regarding copyright and related rights.
- Manage and exploit copyright and related rights in cases where the State is the owner's representative or the State represents the management; receive the transfer of copyright and related rights of organizations and individuals to the State.
- Advise, direct, guide and organize professional training and examination on copyright and related rights protection and development of the cultural industry.
- Manage the activities of collective representative organizations of copyright and related rights and consultancy and services organizations on copyright and related rights.
- Manage and organize the assessment of copyright and related rights; issue, re-issue and revoke assessor's cards and certificates of expertise organizations in accordance with law.
- Issue, re-issue, exchange or invalidate copyright registration certificates and related rights registration certificates; establish and manage the national register of copyright and related rights; attest copyright.
- Coordinate in organizing education, propagation and dissemination of legal knowledge, mechanisms and policies on copyright, related rights and development of cultural industries.
- Organize information, communication, statistics and publishing activities.
- Preside over and coordinate in examining and settling complaints and denunciations about copyright and related rights; coordinate in inspecting and handling violations of the law on copyright and related rights.
- Propose to reward organizations and individuals for achievements.
- Conduct international cooperation and international integration on copyright, related rights and cultural industry.
- Guide and organize the approval of the translation of works from foreign languages into Vietnamese and copying works for teaching and research for non-commercial purposes.
- Guide and organize the exploitation and use of published works, sound recordings and video recordings but cannot find or identify the copyright owner or related right owner.
- Advise, approve and adjust the schedule and method of royalty payment.
- Advise and coordinate in formulating general guidelines, policies and laws on intellectual property rights protection.
- Advise, preside over and coordinate in formulating general guidelines and legal policies on the development of cultural industries.
- Advise and guide the implementation of the Strategy for the development of cultural industries.
- Implement contents of administrative reform and digital transformation according to programs and plans of the Ministry.
- Manage the organization of the apparatus, civil servants, employees and employees; implement benefits and policies towards civil servants, public employees and employees under the management of the Department,
- Manage and use finances, assets, and other resources assigned.
- Perform other duties assigned by the Minister and as prescribed by law.
