What is the confidential level of the health information of the General Secretary of the Central Committee of the Communist Party of Vietnam? Shall the medical examination results of the General Secretary be made public?
Under Article 8 of the Law on Protection of State Secrets 2018, there are regulations on the classification of state secrets as follows:
Classification of state secrets
Based on the importance of their contents and scale of damage in case of divulgence or loss, state secrets are classified into the following 03 levels:
1. State secrets classified as “top secret” are those related to politics, national defense and security, cryptography and foreign affairs whose divulgence or loss can cause exceptionally grave damage to national interest;
2. State secrets classified as “secret” are those related to politics, national defense and security, cryptography, constitution formulation, legislation, judiciary, foreign affairs, economy, resources and the environment, science and technology, education and training, culture, sport, information and communications, healthcare, population, labor and social affairs, organizational structure and official affairs, inspection, supervision, handling of violations, settlement of complaints and denunciations, anti-corruption and state audit whose divulgence or loss can cause extremely grave damage to national interest;
3. State secrets classified as “confidential” are those related to politics, national defense and security, cryptography, constitution formulation, legislation, judiciary, foreign affairs, economy, resources and the environment, science and technology, education and training, culture, sports, information and communications, healthcare, population, labor and social affairs, organizational structure and official affairs, inspection, supervision, handling of violations, settlement of complaints and denunciation, anti-corruption and state audit whose divulgence or loss can cause grave damage to national interest.
Accordingly, based on the importance of their contents and scale of damage in case of divulgence or loss, state secrets are classified into the following 03 levels:
- Top secret;
- State secrets;
- State secrets
At the same time, under Article 1 of Decision 1295/QD-TTg in 2020 promulgating the State List of health sectors, there are the following provisions:
State secrets classified as Secret include:
1. Medical records, information, results of medical examination, treatment and health checkups of comrades in the Politburo and the Party Central Secretariat.
2. Name, origin, virulence, ability to spread and route of transmission of newly discovered and unidentified microorganisms related to human health and life, greatly affecting socio-economic development.
Thus, the health information of the General Secretary of the Central Committee of the Communist Party of Vietnam is considered one of the important medical information classified as Secret, which, if disclosed or lost, may seriously harm national interests. Therefore, the health information of the General Secretary of the Central Committee of the Communist Party of Vietnam must not be made public.
What are the standards for medical staff in charge of health care for the General Secretary of the Central Committee of the Communist Party of Vietnam?
Under Pointm 1, Section 4 of Regulation 121-QD/TW of 2018, there are the following provisions:
IV- STANDARDS AND POLICIES FOR MEDICAL PERSONNEL AND STAFF ENGAGED IN HEALTH PROTECTION AND CARE
1- Standards
1.1- Have professional qualifications to meet the requirements of the task, specifically:
- Doctors working in Departments A11, Inner A, and Internal A1 of hospitals assigned to take care of health care of staff and central health protection departments are general practitioners, with postgraduate degrees from specialty level I or higher in one of the specialties of internal medicine or emergency resuscitation.
- Specialists working in specialized departments and departments are assigned to examine, treat, or perform medical techniques to serve senior staff who are specialists with postgraduate degrees from specialty level I or higher.
- Medical staff working in subclinical departments, functional exploration ... assigned to perform medical techniques for senior staff who are specialists with postgraduate degrees from specialty level I or higher or bachelor's in the right majors with university degrees or higher.
1.2- Have good political and moral qualities; have a sense of responsibility, and dedication to serve and take care of the health of staff in any circumstances.
2- With regard to doctors who access and serve members of the Politburo, Secretary of the Party Central Committee, Chairperson of the Central Committee of the Vietnam Fatherland Front, Vice Presidents, Deputy Prime Ministers, and Vice Presidents of the National Assembly, in addition to the above criteria, must be members of the Communist Party of Vietnam (hospitals propose to report the list to the Central Committee for Health Care and Protection for approval).
3. Health monitoring doctors who serve senior officials when they retire to enjoy social insurance benefits, but are contracted by the unit to work part-time, if arranged to participate in health monitoring, serve senior officials with the title of members of the Politburo, etc The Secretary of the Party Central Committee, the Chairperson of the Central Committee of the Vietnam Fatherland Front, the Vice President, the Deputy Prime Minister and the Vice Chairperson of the National Assembly must be considered by the Central Committee for Health Care and Protection on a case-by-case basis.
4- Access doctors assigned to manage and care for the health of senior officials must strictly observe regulations on the confidentiality of officials' medical records.
5. The Central Committee for Health Care and Protection shall take charge of and coordinate with the Central Organization Committee, the Party Personnel Committee, and functional agencies in, researching and proposing competent authorities to promulgate reasonable benefits and policies for medical staff and employees engaged in health care and protection.
According to the above-mentioned contents, health care staff for the General Secretary must fully meet the above strict standards.
Is the General Secretary of the Central Committee of the Communist Party of Vietnam subject to daily health check-ups?
Under Point 2 Section 2 of Regulation 121-QD/TW of 2018, there are the following provisions:

2. The health examination and monitoring for officials in Vietnam and on domestic and foreign working trips
2.1- The health examination and monitoring at home or workplace
- For key officials (General Secretary, State President, Prime Minister, Chairperson of the National Assembly): Doctors shall provide daily health check-ups.
- For members of the Politburo and Secretary of the Party Central Committee: Doctors monitor their health at least 2 times a week or daily depending on the health developments of officials.

Accordingly, doctors shall provide daily health check-ups for the General Secretary of the Central Committee of the Communist Party of Vietnam who is one of the key officials.
