What are the documents and procedures for visiting martyrs' graves in Vietnam?

Pursuant to the provisions of Clause 1, Article 158 of Decree 131/2021/ND-CP as follows:

Documents and procedures for visiting martyrs' graves
1. The person who visits the martyr's grave shall send the following documents to the Department of Labor - Invalids and Social Affairs in the locality where the martyr's original file is managed:
a) An application form for visiting martyrs' graves, made according to Form No. 31, Appendix I of this Decree.
b) Certified copy from one of the following papers: certificate of family or relatives of martyrs; decide on subsidies for martyrs' worship.
c) One of the following papers:
For the case of a martyr's grave with full information: the notification of the martyr's grave of the Department of Labor, War Invalids and Social Affairs where the grave is managed.
For cases where a specific grave in the martyr's cemetery has not yet been identified: a certificate issued by the Department of Labor, War Invalids and Social Affairs where the grave is managed, of being on the management list of the cemetery; an extract of the martyr file issued by the Department of Labor - Invalids and Social Affairs where the original file is managed; a certified copy of the certificate of information about the place where the martyr died, made according to Form No. 44, Appendix I of this Decree.

Thus, according to regulations, records of visiting martyrs' graves include:

- An application form to visit the martyr's grave;

- Certified copy from 01 of the following papers: certificate of family or relatives of martyrs; decide on subsidies for martyrs' worship.

- Notification of martyrs' graves (For the case of martyrs' graves with full information).

- Certificate of being on the management list of the cemetery; an extract of the martyr's file; certified copy from the certificate of information about the place where the martyr died (For the case where the specific grave in the martyr's cemetery has not been identified).

What is the procedure for visiting martyrs' graves in Vietnam?

In Article 158 of Decree 131/2021/ND-CP, there are regulations on procedures for visiting martyrs' graves as follows:

Records and procedures for visiting martyrs' graves
1. The person who visits the martyr's grave shall send the following documents to the Department of Labor - Invalids and Social Affairs in the locality where the martyr's original file is managed:
a) An application form for visiting martyrs' graves, made according to Form No. 31, Appendix I of this Decree.

c) One of the following papers:

2. The Division of Labor, War Invalids and Social Affairs in the locality where the martyr's original file is managed is responsible for inspecting and issuing a letter of recommendation to visit the martyr's grave using Form No. 42, Appendix I of this Decree within a period of time. 3 working days from the date of receipt of complete documents.
3. The People's Committee of the commune where the grave is managed or the locality where the martyr died within 01 working day shall have to certify in the letter of recommendation to visit the martyr's grave.
4. The person who visits the martyr's grave sends a letter of recommendation to visit the confirmed martyr's grave to the local Department of Labor - Invalids and Social Affairs where the martyr's original file is managed to receive support.
5. The Division of Labor, War Invalids and Social Affairs in the locality where the martyrs' original records are managed shall pay support to visit the martyrs' graves within 2 working days from the date of receipt of the certified letter of recommendation. the commune-level People's Committee of the place to visit the grave or the locality where the martyr died.

Thus, procedures for visiting martyrs' graves are carried out in the above order.

Accordingly, after submitting the application, the Department of Labor - Invalids and Social Affairs in the locality where the martyr's original file is managed is responsible for inspecting and issuing a referral to visit the martyr's grave. Within 01 working day, the People's Committee of the commune where the grave is managed or the locality where the martyr died shall certify in the letter of recommendation to visit the martyr's grave.

The person visiting the martyr's grave sends a letter of recommendation to visit the confirmed martyr's grave to the local Department of Labor - Invalids and Social Affairs where the martyr's original records are managed to receive support. And the Department of Labor - Invalids and Social Affairs in the locality where the original records of the martyrs are managed shall pay support to visit the martyrs' graves.
