How much is the fee for marriage registration at the commune-level People's Committee in Vietnam?

Pursuant to Clause 1, Article 17 of the Law on Civil Status 2014, Commune-level People's Committees of the place of residence of either of the male and female partners shall make marriage registration.

At the same time, according to Article 11 of the Law on Civil Status 2014, the fee for marriage registration at the commune-level People's Committee is as follows:

Civil status fees
1. Civil status fees shall be exempted in the following cases:
a/ Civil status registration for members of families that have rendered meritorious services to the revolution; members of poor households; persons with disabilities;
b/ Birth and death registration on time, guardianship and marriage of Vietnamese citizens residing in the country.
2. Individuals who request registration of civil status events other than those prescribed in Clause 1 of this Article or issue of civil status extract copies shall pay a fee.
The Ministry of Finance shall stipulate in detail the competence to collect, fee rates and the management and use of civil status fees.

Accordingly, if Vietnamese citizens residing in the country register their marriage at the commune-level People's Committees, they will be exempted from the marriage registration fee (previously this fee was regulated to a maximum of 30,000 VND).

Pursuant to subsection 2, Section C, Part II of the Appendix issued together with Decision 2228/QD-BTP in 2022, the components of a marriage registration dossier submitted to the commune-level People's Committee include:

- Marriage registration declaration form, with sufficient information of both male and female parties. Both men and women can make a joint declaration of marriage registration

- The person who requests marriage registration shall submit/present (in person) the following documents:

Documents to be submitted:

+ The original of the certificate of marital status issued by the competent commune-level People's Committee in case the marriage registration requester does not register his/her permanent residence in the commune, ward or township where the registration procedures are carried out.

In case the information on marital status is already in the Vietnam National Database, the electronic database is automatically filled in, and may not be required to be presented.

Documents to be presented:

+ Passport or people's ID card or citizen ID card or other papers with photo and personal information attached by a competent authority, still valid for use to prove the identity of the relatives of the subject of the birth registration request. In case the personal information in these documents is already in the Vietnam National Database, the Electronic National Database, and is automatically filled in by the system, and may not be required to present it.

+ Proof of residence. In case the information on documents proving the place of residence is already in the Vietnam National Database and is automatically filled in, it is not necessary to present it.

+ Extract divorce notes for cases where Vietnamese citizens registered their permanent residence in the commune to carry out the procedures for marriage registration, and their previous divorce or marriage annulment has been resolved at a competent agency.

Notes for documents submitted or presented if the requester submits the application in the above direct form:

+ For papers presented during civil status registration, the recipient is responsible for checking and comparing with the information in the declaration, taking pictures or recording information to save in the file and return it to the presenter, and may not be required to submit a copy or photocopy of such document.

+ The civil status registration requester may submit a certified true copy of the original or a copy issued from the original book or a photocopy enclosed with the original papers for comparison. In case the requester submits a photocopy enclosed with the original document, the receiver is responsible for checking and comparing the photocopy with the original and signing for certification.

+ The recipient is responsible for properly and fully receiving civil status registration dossiers in accordance with the civil status law, and must not require civil status registrants to submit additional papers which are not required by civil status law to be submitted.

How long does it take to issue a marriage certificate at the Commune People's Committee in Vietnam?

Pursuant to Clause 2, Article 18 of the Law on Civil Status 2014 stipulates that immediately after receiving complete papers specified in Clause 1 of this Article, if seeing that the marriage conditions are fully met in accordance with the Law on Marriage and Family, the justice and civil status officer shall record the marriage in the civil status book and together with the male and female partners sign in the civil status book.

The male and female partners shall both sign the marriage certificate; the justice and the civil status officer shall report to the chairperson of the commune-level People's Committee to organize the handover of the marriage certificate to the couple.

In case of necessity to verify the marriage conditions of the male and female partners, the time limit for settlement is 5 working days.
