Pursuant to the provisions of Section 1, Part A, Procedures promulgated together with Decision No. 1724/QD-BTP in 2020, stipulating the application for issuance of an auction practice certificate includes:
- An application form for an auction practice certificate;
- A certified true copy or a copy enclosed with the original for comparison of the university diploma or above, university degree in one of the majors of law, economics, accounting, finance or banking;
- A certified true copy or a copy enclosed with the original for comparison of the auctioneer vocational training graduation certificate;
- A written certification of passing the examination of the results of the auctioneer apprenticeship;
- Judicial record card;
- 01 color photo size 3cm x 4cm.

Pursuant to the provisions of Section 1, Part A, Procedures promulgated together with Decision No. 1724/QD-BTP in 2020 stipulating the procedures for issuance of auction practice certificates as follows:
About the order of execution:
The following qualified persons shall be granted an auction practice certificate:
- Vietnamese citizens permanently residing in Vietnam, complying with the Constitution and laws, having good moral qualities;
- Having a university or postgraduate diploma in one of the majors of law, economics, accounting, finance or banking;
- Graduated from Auction Vocational Training Course:
Eligible person:
++ Vietnamese citizens permanently residing in Vietnam, complying with the Constitution and laws, having good moral qualities;
++ Possessing a university or postgraduate diploma in one of the majors of law, economics, accounting, finance or banking;
+ Having worked in the field of training for 3 years or more, may participate in the auctioneer training course.
- The duration of the auctioneer training course is 6 months. The person who completes the auctioneer vocational training course shall be granted a certificate of completion of the auctioneer vocational training course by the auctioneer vocational training institution.
Except for cases of exemption from auctioneer training:
+ Persons who have worked as lawyers, notaries, bailiffs, arbitrators or arbitrators with a practice period of 02 years or more.
Persons who are already judges, prosecutors or enforcers.
- Satisfy the requirements for checking the results of the auctioneer apprenticeship.
The Minister of Justice shall consider and decide to grant auction practice certificates.
How to perform:
Eligible persons send a set of dossiers of application for an auction practice certificate to the Ministry of Justice.
In case an applicant for an auction practice certificate submits an application directly to the Ministry of Justice, he/she shall present the original of his/her university diploma or post-graduate degree in one of the majors of law, economics, accounting, finance, banking and vocational training graduation certificates for comparison.
In case an applicant for an auction practice certificate sends an application by post, a certified true copy of the university diploma or post-graduate degree in one of the majors of law, economics, accounting, finance, banking and a certified true copy of the Auction Vocational Training Graduation Certificate.
Deadline for settlement:
- Within 15 days after receiving complete and valid dossiers, the Minister of Justice shall decide to grant auction practice certificates; In case of refusal, the reason must be notified in writing.
Persons who are refused the issuance of auction practice certificates have the right to complain and initiate lawsuits in accordance with law.
What are the requirements and conditions for carrying out the procedures for issuance of auction practice certificates in Vietnam?
Pursuant to the provisions of Section 1, Part A, Procedures promulgated together with Decision No. 1724/QD-BTP in 2020 stipulating the requirements and conditions for carrying out the procedures for issuance of an auction practice certificate as follows:
Persons falling into one of the following circumstances shall not be granted an auction practice certificate:
- Does not meet the following criteria:
+ Vietnamese citizens permanently residing in Vietnam, complying with the Constitution and laws, having good moral qualities;
+ Having a university or postgraduate degree in one of the majors of law, economics, accounting, finance or banking;
+ Graduating from the auctioneer vocational training course specified in Article 11 of the 2016 Law on Property Auction of Vietnam, except for cases of exemption from auctioneer training prescribed in Article 12 of the 2016 Law on Property Auction of Vietnam.
+ Satisfying the requirements for checking the results of the auctioneer apprenticeship.
- Being an officer, professional soldier, defense worker or officer in an agency or unit of the People's Army; officers, professional non-commissioned officers, officers and technical non-commissioned officers in agencies and units of the People's Public Security; cadres, civil servants and public employees, except for the case of civil servants and public employees who are requested to issue an auction practice certificate to work for the asset auction service center.
- Loss or restricted civil act capacity; have difficulty in cognition and behavior control.
- Being prosecuted for criminal liability; has been convicted and the judgment has taken legal effect; has been convicted but has not yet been expunged; has been convicted of fraud, appropriation of property, crimes of corruption even in cases where criminal records have been expunged.
- Being subject to administrative handling measures sent to a compulsory rehabilitation center or compulsory education institution in accordance with the law on handling of administrative violations.
