At what age do children start primary school?
Pursuant to the provisions of Article 33 of the regulations issued in conjunction with Circular 28/2020/TT-BGDDT, the following is clearly stated:
Age of primary school students
1. The age for students entering the first grade is 06 years old, calculated according to the year. Children with disabilities, delayed physical or intellectual development, children from areas with particularly difficult socio-economic conditions, ethnic minority children, orphans without caregivers, children returning from abroad, and children of foreigners studying or working in Vietnam can enter the first grade at an older age, but not more than 03 years beyond the regulation. In cases where children enter the first grade at an age exceeding 03 years beyond the regulation, the decision will be made by the Head of the Department of Education and Training.
2. Primary school students may study at an older age if they have repeated a grade, are from areas with particularly difficult socio-economic conditions, are ethnic minorities, are disabled, have delayed physical or intellectual development, are orphans without caregivers, are returning from abroad, or fall into other cases as per legal regulations.
Additionally, pursuant to the provision of clause 1 Article 28 of the Law on Education 2019, it is stated as follows:
Levels and age of general education
1. The levels and age for general education are stipulated as follows:
a) Primary education is conducted over 05 academic years, from the first grade to the end of the fifth grade. The age for students entering the first grade is 06 years old, calculated according to the year;
b) Lower secondary education is conducted over 04 academic years, from the sixth grade to the end of the ninth grade. Students entering the sixth grade must complete the primary education program. The age for students entering the sixth grade is 11 years old, calculated according to the year;
c) Upper secondary education is conducted over 03 academic years, from the tenth grade to the end of the twelfth grade. Students entering the tenth grade must have a lower secondary education diploma. The age for students entering the tenth grade is 15 years old, calculated according to the year.
The age for students entering the first grade is 06 years old, calculated according to the year. Thus, the age for primary school students is calculated as follows:
- Age of first grade students: 06 years old- Age of second grade students: 07 years old- Age of third grade students: 08 years old- Age of fourth grade students: 09 years old- Age of fifth grade students: 10 years old
Note:

What are the responsibilities of primary school students?
Pursuant to the provisions of Article 34 of the regulations issued in conjunction with Circular 28/2020/TT-BGDDT, the responsibilities of primary school students include:
- Studying and training according to the school's education plan and regulations; having a self-conscious attitude towards studying and training to comprehensively develop qualities and abilities based on the goals of the primary education program.
- Fully and effectively fulfilling academic tasks; knowing how to self-study under the guidance of teachers; actively participating in experiential activities and applying learned knowledge to real-life situations; maintaining physical health and personal hygiene.
- Being filial to parents and grandparents; showing respect and politeness to teachers and elders; being united, loving, and helping friends, younger siblings, the elderly, people with disabilities, and those in difficult circumstances.
- Complying with the regulations, protecting the school's property and public property; adhering to traffic safety rules; maintaining cleanliness and protecting the environment.
- Contributing to activities that build, protect, and promote the traditions of the school and local community.
What are the rights of primary school students?
Pursuant to the provisions of Article 35 of the regulations issued in conjunction with Circular 28/2020/TT-BGDDT, the rights of primary school students include:
- The right to education+ Being educated and learning to develop comprehensively and best utilize personal potential; studying at a school that offers the primary education program convenient for traveling within the residential area.+ Students can choose or transfer to another school outside the residential area if the school can accommodate them.+ Primary school-aged students returning from abroad, children of foreigners studying or working in Vietnam, and children in difficult circumstances not attending school can enroll in a primary school after the principal organizes a proficiency assessment to place them in the appropriate grade.+ Disabled students can integrate and study at a primary school with guaranteed conditions for study and training; they are to be educated and assessed according to their individual education plans.+ Students can accelerate their education program, learn at an older age, extend their study time, or repeat a grade.+ Students with exceptional physical and intellectual development may advance to a higher grade within the education level. Procedures for consideration are as follows:- Parents or guardians of the student file a request with the school.- The school principal forms an advisory survey board, including the principal or vice principal, the school's Parent Representative Committee, the student's current teacher, the teacher of the class above, a health staff member, and the Team General Leader.- Based on the advisory survey results, the principal completes the documentation and submits it to the Head of the Department of Education and Training for consideration and decision.+ Students with limited academic results, despite receiving direct guidance from teachers, parents, or guardians and still not achieving, depending on the degree of uncompleted academic and training tasks, the teacher reports to the principal for consideration of promotion or retention, and cooperates with the family to decide on appropriate educational measures.
- The right to protection, care, respect, and equal treatment; safeguarding legitimate rights and interests; receiving full information about personal study and training process; ensuring time, facilities, hygiene, and safety for study and training.
- The right to participate in activities that promote individual abilities; expressing personal opinions and aspirations.
- The right to scholarships and social policies according to regulations.
- Other rights as stipulated by law.
