How to record the administrative record of the injured and other related persons in a traffic accident in Vietnam?
According to Article 13 of Circular 63/2020/TT-BCA, the recording of administrative record from the injured and other related persons in a traffic accident is prescribed as follows:
- The statement form for the injured and other related persons in a traffic accident, using Form No. 10/TNDB issued under Circular 63/2020/TT-BCA, must clearly state:
+ Time, place of the report; full name, position of the person making the report.
+ Full name, address, occupation, and personal details of the injured and other related persons.
+ Time and place of the accident, traffic density; administrative record of the injured and related persons.
- The statement content must clarify the developments and cause of the accident, and any injuries caused by the accident.
- In cases where there are seriously injured persons or potential fatalities, administrative record must be recorded immediately; questions should be asked succinctly and clearly. If the injured person cannot speak due to serious injury, a record must be made of this fact.
What types of reports are included in the administrative records of those involved in a traffic accident in Vietnam?
According to point d, clause 2 of Article 20 Circular 63/2020/TT-BCA, it is prescribed as follows:
Resolution of traffic accidents showing signs of a crime as per the functions of the assigned investigation authorities
1. During the investigation, verification, and resolution of a traffic accident, if signs of a crime are detected, the assigned officer of the Traffic Police Department shall report to the Director, and the officer assigned to the investigation and resolution of the traffic accident in the provincial Traffic Police Department shall report to the Head of the Department for the Director and Head of the Department to decide on the criminal case initiation and perform investigation duties and powers according to Article 38 of the Law on Organization of Criminal Investigation Authorities 2015 and Article 40 of the Criminal Procedure Code 2015.
2. The traffic accident file transferred to the Investigation Police Authority includes:
a) Some documents used for the authority assigned to perform certain investigative activities issued under Circular No. 61/2017/TT-BCA dated December 14, 2017, by the Minister of Public Security regulating forms, papers, and books on criminal investigation (Circular No. 61/2017/TT-BCA);
b) Site examination report of the traffic accident; Site layout of the traffic accident; Photos of the scene; image storage devices (if any);
c) Vehicle examination report; Seizure record of exhibits and vehicles; decision on seizure of exhibits and vehicles; papers of the vehicle operator, vehicle, and goods on the vehicle (if any);
d) administrative record of those involved in the traffic accident including: administrative record of the vehicle operator; administrative record of the injured; administrative record of other related persons in the traffic accident; administrative record of witnesses, those who know about the incident;
dd) Record of injuries on the injured persons, Diagram of injury positions on the injured person's body, Reconstruction of the traffic accident scene (if any);
e) Documents proving damage to persons and property; other related documents (if any);
g) Exhibits, vehicles, evidence related to the accident (if any);
h) Case file handover record according to Form No. 219 Circular No. 61/2017/TT-BCA.
Thus, according to the aforementioned regulations, the administrative records of those involved in a traffic accident include:
- Statement of the vehicle operator.
- Statement of the injured.
- Statement of other related persons in the traffic accident.
- Statement of witnesses, those who know about the incident.
