What is the non-stop electronic toll collection in Vietnam?

Non-stop electronic toll collection (ETC) is mentioned Clause 4, Article 3 of Decision 19/2020/QD-TTg as follows:

Article 3. Interpretation of terms
For the purpose of this Decision, these terms below shall be construed as follows:
...
"ETC” is a method to automatically collect the toll charged to road vehicles, the road vehicles do not necessarily stop to pay the toll when they approach a toll booth. The toll shall be automatically charged by a non-stop electronic toll collection system (hereinafter referred to as “ETC system”).

Can a vehicle be equipped multiple transponders in Vietnam?

According to Article 4 of Decision 19/2020/QD-TTg, there are regulations on the principles of ETC as follows:

Article 4. ETC principles
1. Make ETC more effective, transparent and modern.
2. Ensure the investor’s right to collect toll under a project contract concluded with the Competent Authority.
3. Meet the requirements pertaining to interconnectivity between ETC systems, between Manual Toll Collection (MTC) system and ETC system at every toll booth and the entire system; each vehicle is only equipped with 1 transponder to be used for every toll booth nationwide; the management, operation and collection at toll booth (also including mixed-used toll lane), after application of ETC, shall be solely done by one unit.
4. Ensure the user’s information security, except for information to be provided under a decision of the Competent Authority as prescribed by law.
5. Ensure information shall be integrated and provided adequately and promptly for state management purpose as prescribed by law.
6. Increase the speed of vehicles going through a toll booth, reduce environment pollution, save social costs, facilitate cashless payments and bring convenience to users.

Thus, each vehicle is only equipped with 1 transponder to be used for every toll booth nationwide

Can an ETC account be used for paying tolls charged to multiple vehicles in Vietnam?

According to Article 10 of Decision 19/2020/QD-TTg, the regulations on opening an ETC account are as follows:

Article 10. Opening an ETC account
1. An ETC provider shall open an ETC account for a vehicle user on the ETC system upon the first installation of a transponder.
2. Each ETC account may be used for paying tolls charged to multiple vehicles, but each vehicle’s toll is paid solely from an ETC account.
3. An ETC account shall be stored in the data base of toll collection system, containing:
a) Contact information of the vehicle user: ID number or passport number; business identification number, place of residence address or head office address; phone number and email address receiving ETC invoices/documents.
b) Identification number of vehicle whose toll is paid from the ETC account.
c) Weight, number of seats, type, license plate.
d) Account balance, transaction history.
4. In case of any change of information prescribed in Point a, Point c Clause 3 of this Article, the vehicle user shall, within 10 days from the day on which the change occurs, notify the ETC provider to update such change in the ETC system.
5. Within 5 days after receiving such a notice of change as prescribed in point c clause 3 hereof, the motor vehicle registry shall update such change on the ETC system.

Thus, each ETC account may be used for paying tolls charged to multiple vehicles, but each vehicle’s toll is paid solely from an ETC account.

What will the driver in case of a road vehicle which has not enough balance in the ETC account to pay a toll on ETC lane do?

Pursuant to Article 11 of Decision 19/2020/QD-TTg, the regulations on using an ETC account as follows:

Article 11. Using an ETC account
1. The vehicle user may top up his/her ETC account (at the toll booth, via banking service and other form) to use ETC service as per regulation.
2. A road vehicle with transponder which has not enough balance in the ETC account to pay a toll on ETC lane must change to the mixed-use lane.
3. The ETC provider shall open an account in a commercial bank to receive tolls charged to vehicle users going through ETC booths.
4. The ETC provider is responsible for managing the amount of money that vehicle users topped up the accounts of the ETC provider as per the law.

Thus, a road vehicle with transponder which has not enough balance in the ETC account to pay a toll on ETC lane must change to the mixed-use lane.

Can the paper proof of payment be used for ETC in Vietnam?

ETC proof of payment is prescribed in Article 16 of Decision 19/2020/QD-TTg as follows:

Article 16. ETC proof of payment
1. ETC proof of payment shall be issued in electronic form. ETC proof of payment must bear digital signature of the issuer as per the law.
2. No paper proof of payment is allowed for ETC. Where appropriate, electronic proof of payment may be printed for checking and comparison purpose as required by the regulatory agency.

Thus, instead of using paper proof of payment for ETC, the electronic proof of payment must be used.
