What is an embossed seal? What is the application for registration of embossed seals in Vietnam?

The concept of an embossed seal is defined according to the provisions of Clause 6, Article 3 of Decree 99/2016/ND-CP as follows:

Embossed seal is the one which has information on its surface like the wet seal. When affixed on documents or papers, the information on the surface of seal shall be embossed.

Accordingly, state agencies, organizations and titles that wish to register embossed seals will prepare 01 set of documents as prescribed in Article 14 of Decree 99/2016/ND-CP, subsection 5, Section B, Part II Administrative procedures issued together with Decision 3191/QD-BCA in 2022.

Specifically, include:

- Dossier for the person appointed to submit the application:

+ Letter of introduction or power of attorney;

+ Citizen ID card or valid ID card or Passport.

- Dossier for state agencies, organizations and titles: A document stipulating that state agencies, organizations and titles have the function of granting diplomas, certificates and papers with photos attached or sealing documents of the competent authority.

Pursuant to subsection 5, Section B, Part II Administrative procedures promulgated together with Decision 3191/QD-BCA in 2022, the application for registration of embossed seals shall be submitted in the following ways:

- Submit dossiers directly or via postal service at the application-receiving department of the Police Department for administrative management of social order - the Ministry of Public Security.

- Submit the application through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security (except for documents and papers that are not allowed to be posted online as prescribed by law).

The current procedure to carry out procedures for registration of embossed seals is done with the following steps:

Step 1: State agencies, organizations and titles that wish to register embossed seals such as granted seals shall submit dossiers directly or via postal service at the Police Department for administrative management of social order - The Ministry of Public Security during office hours on weekdays or submit an application online through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.

Step 2: The receiving officer checks the validity and composition of the application.

- If the dossier is valid and has sufficient components, the dossier shall be received for settlement and sent a receipt of the dossier directly or by postal service or by email (if any) to the person assigned by the agency, or organization, or the title sent to contact to submit the application.

- If the dossier is invalid or lacks components, the dossier shall not be accepted and the Instructions for completing the dossier shall be sent directly or via postal service or by email (if any) to the person assigned by the agency or organization or titles of the state sent to contact for dossier submission.

- If the application does not meet the requirements according to regulations on management and use of the seal, the application will not be accepted, clearly stating the reason for the refusal to process the application and send a Notice of refusal to handle the application directly or by postal service or by email (if any) to the person sent by a state agency, organization or title to contact them for filing.

Step 3: Based on the appointment date on the Receipt of the application, the person sent by the state agency, organization or title to submit the application will receive the results directly or through the postal service. seal and seal sample registration certificate.

What are 04 things to pay attention to when state agencies, organizations and titles register for embossed seals in Vietnam?

Pursuant to Article 5 of Decree 99/2016/ND-CP, subsection 5, Section B, Part II Administrative procedures promulgated together with Decision 3191/QD-BCA in 2022. When state agencies, organizations and titles register an embossed seal, it is necessary to note the following 04 contents:

- Agencies, organizations and titles of the state may only use one seal according to the seal sample prescribed by a competent state agency.

- Agencies, organizations and titles of the state that have the function of granting diplomas, certificates and papers with photos attached or sealing documents as prescribed by law are allowed to use embossed seals. State agencies, organizations and titles shall decide for themselves the use of additional embossed seals, miniature seals, and wax seals.

- In case of direct submission: Documents and papers included in the dossier are originals or certified copies or copies enclosed with the originals for comparison by the receiving officer in accordance with law.

- In case of online submission: documents and papers in the dossier are electronic documents signed digitally by a competent person and digitally signed by agencies or organizations as prescribed by law (e-documents in PDF format).
