What is a violation of the principles of organization and operation of Communist Party of Vietnam?

In subsection 3, Section III of Guideline 05/HD-UBKTTW in 2022, there are instructions on identifying violations of the Communist Party of Vietnam's principles of organization and operation in order to discipline CPV members as follows:

- Directing, researching, thoroughly grasping and organizing the implementation of the Communist Party of Vietnam's guidelines and regulations, the State's laws and regulations, and the Charter and regulations of the Fatherland Front, social and political organizations in a timely, incorrect and incomplete manner.

- Failing to develop specific programs and action plans according to assigned tasks; failing to assign specific tasks to units, organizations and individuals in implementing or formulating programs and plans leading to violations of organizations or CPV members.

- Bureaucracy, away from the masses, not close to the base, lack of inspection and urging, not sure about the situation of their localities, agencies and units; indifference, insensitivity, irresponsibility to the difficulties, pressing and legitimate demands of the people.

- Taking notes and reflecting dishonestly on opinions, statements and discussions of CPV members, conclusions of heads of Communist Party of Vietnam committees and organizations.

How to handle the CPV members who violate the principles of organization and operation of Communist Party of Vietnam?

Pursuant to Article 26, Regulation 69/QD-TW in 2022 stipulates as follows:

Violations of the Communist Party of Vietnam's principles of organization and operation
1. CPV members who violate one of the following circumstances, causing less serious consequences, shall be disciplined in the form of reprimand:
a) Lack of responsibility in the observance of the Communist Party of Vietnam's guidelines and regulations and the State's laws.
b) Being provoked, instigated, bribed, manipulated or coerced to participate in activities causing loss of democracy and internal unity.
c) Being instigated or manipulated to violate the Communist Party of Vietnam's principles of organization and operation; violate the regulations on democracy, working regulations of the Communist Party of Vietnam committees and organizations, and regulations of agencies, organizations and units where they work and live.
d) Threatening to take revenge or persecute those who question, comment, criticize or denounce themselves or witnesses in any form.
dd) Failing to comply with the reporting, information and question-answering regime in accordance with regulations of the Communist Party of Vietnam and State.
e) Slandering and criticizing others with impure personal motives.
2. If a person who has been disciplined under Clause 1 of this Article re-commits or commits a violation for the first time, causing serious consequences, or violates one of the following circumstances, the discipline shall be in the form of warning or dismissal (if there is a person in charge):
a) Taking advantage of positions and powers to veto opinions of the majority of members when passing resolutions or regulations falling within the collective's competence.
b) Participating in or inciting or forcing others to participate in divisive or partial activities that cause internal disunity.
c) Making false reports, distorting the truth; conceal defects or violations of oneself, others or the organization; create fake achievements; opportunity, position trumpet.
d) Being partial, factional, authoritarian, autocratic in direction and administration, leading to violation of the principle of democratic centralism.
d) Promulgating documents or doing things contrary to the documents of the Communist Party of Vietnam committee or organization.
e) Taking advantage of the principle of democratic centralism to mobilize individuals, dominate the collective, decide according to subjective will to benefit individuals, relatives and groups.
g) Taking advantage of positions and powers to suppress subordinates, take revenge, or persecute people with minority or contrary opinions.
h) Failing to comply with the guidelines and regulations of the superior CPV organization.
i) Acting contrary to resolutions, directives and regulations that have been unanimously approved or promulgated by the Communist Party of Vietnam committees, organizations, and leaders of agencies and units.
k) Failing to strictly observe the principles of organization and operation of the Communist Party of Vietnam; loss of will to strive, not being exemplary in work; avoidance, irresponsibility, failure to fulfill assigned duties and responsibilities.
3. In case of violations specified in Clauses 1 and 2 of this Article, causing very serious consequences or in one of the following cases, the discipline shall be in the form of expulsion:
a) Being disorganized, undisciplined, quit their positions many times without legitimate reasons; acts against the guidelines and regulations of the Communist Party of Vietnam and laws of the State.
b) Taking advantage of democratic rights for factions, group interests or local interests to cause disunity in organizations, agencies and units where they live or work.
c) Revenging, punishing people who comment, fight, criticize, denounce or provide information, documents, evidences, witnesses related to violations committed by agencies, units or organizations, personally.

Accordingly, based on the case of violation and the level of violation of the violation to determine the form of disciplinary action against CPV members who violate the Communist Party of Vietnam's principles of organization and operation according to the above provisions.

Disciplinary action to be taken will include reprimand; warning or dismissal; expelled from the Communist Party of Vietnam.

How to determine the consequences of violations principles of organization and operation of Communist Party of Vietnam?

Clause 5, Article 3 of Regulation 69/QD-TW in 2022 explains the consequences of violations when considering disciplinary sanctions against CPV members as follows:

- Violation causing less serious consequences: is a violation of small nature, extent and harm, adversely affecting the reputation of oneself and the CPV organization, agency or unit where the CPV member lives, go on bussiness.

- Violation causing serious consequences: is a violation of great nature and degree of harm, causing bad public opinion among cadres, CPV members and the people, and reducing the prestige of themselves and CPV organizations and agencies, the unit where CPV members live and work.

- Violation causing very serious consequences: It is a violation of great nature and degree of harm, causing bad public opinion, very urgent among cadres, CPV members and people, and discrediting CPV organizations, agencies and units where CPV members live and work.

Guideline 05/HD-UBKTTW in 2022 takes effect from November 22, 2022.
