Procedure for Initial Medical Examination for Occupational Diseases
Based on Section 7, Part II of the revised administrative procedures in the field of medical assessment under the management of the Ministry of Health issued with Decision 2285/QD-BYT in 2023, the procedure for the initial medical examination for occupational diseases is regulated as follows:
Step 1: The employee is responsible for preparing and completing the medical examination file and submitting it to the Medical Assessment Council (based on clause 1, Article 11, Circular 56/2017/TT-BYT).
Step 2: Based on the inspection file, the permanent authorities of the Medical Assessment Council are responsible for reviewing and organizing the medical examination in accordance with the legally stipulated time. Within 60 days from the date of receiving all documents, the Medical Assessment Council is responsible for organizing the medical examination and issuing a medical assessment report.
In case the above-stipulated time is exceeded without issuing a report, a written notification must be provided with a clear explanation (based on clause 2, Article 11, Circular 01/2023/TT-BYT/based on point d, clause 2, Article 39, and clause 3, Article 166, Decree 131/2021/ND-CP).

What Documents Are Included in the Initial Occupational Disease Examination File?
Based on Section 7, Part II of the revised administrative procedures in the field of medical assessment under the management of the Ministry of Health issued with Decision 2285/QD-BYT in 2023, the initial occupational disease examination file includes:
- Worker's introduction letter from the employer according to the template in Appendix 1 attached with Circular 18/2022/TT-BYT for cases where the worker under inspection is under the management of the employer at the time of the examination request, or Worker’s examination request form according to the template in Appendix 2 attached with Circular 18/2022/TT-BYT for cases where the worker is no longer in a job with the risk of occupational disease but is still within the guaranteed period of the disease, including workers preserving the time of social insurance contributions, workers awaiting retirement, pension settlement, or receiving monthly pensions.
- Original or certified copy of the Occupational Disease Dossier.
- Summary of medical records related to the treatment of the occupational disease (if any). For examinees as specified in point c, clause 1, Article 47 of the Law on Occupational Safety and Hygiene: the summary must clearly state that the occupational disease is untreatable.
- One of the following ID documents with a photo:
+ Identification card;
+ Citizen identification card;
+ Valid passport.
If these documents are unavailable, a Police-issued certificate with a photo, stamped with a cross-stamp on the photo, issued within 3 months from the examination request must be provided.
What Conditions Must Be Met to Receive Occupational Disease Examination Financial Support?
As stipulated in Article 16 of Decree 88/2020/ND-CP:
Conditions for occupational disease examination support for workers
Employers are entitled to financial support for occupational disease examinations for workers as stipulated in point a, clause 2, Article 56 of the Law on Occupational Safety and Hygiene when workers meet the following conditions:
1. Have paid accident insurance and occupational disease premiums for 12 months or more and continue to participate until the month preceding the month requesting financial support for occupational disease examination;
2. Have been diagnosed with occupational diseases in licensed medical examination and treatment facilities.
Employers are entitled to financial support for occupational disease examinations for workers when the following conditions are met:
- Have paid accident insurance and occupational disease premiums for 12 months or more and continue to participate until the month preceding the month requesting financial support for occupational disease examination;
- Have been diagnosed with occupational diseases in licensed medical examination and treatment facilities.
