Where to Apply for a Marriage Registration Certificate?
According to the provisions of Article 17 of the Civil Status Act 2014 and Article 37 of the Civil Status Act 2014, when applying for a marriage registration certificate, both parties must go to the district or commune-level People's Committee, specifically:
- District People's Committee where Vietnamese citizens reside to conduct marriage registrations with foreign elements, specifically:
+ Between a Vietnamese citizen and a foreigner;+ Between a Vietnamese citizen residing within the country and a Vietnamese citizen residing abroad; between Vietnamese citizens residing abroad with each other;+ Between a Vietnamese citizen holding dual nationality and a Vietnamese citizen or a foreigner.
- Commune-level People's Committee where one of the two parties resides to conduct marriage registrations without foreign elements.

Documents Required for Applying for a Marriage Registration Certificate
According to the instructions on marriage registration procedures at Section 2 Part II Decision 2228/QD-BTP 2022, when applying for a marriage registration certificate, both parties must prepare the following documents:
When applying for marriage registration, the following documents are required:
- A marriage registration declaration form, fully detailing information of both parties. Both parties may jointly fill out one marriage registration declaration form (if they choose to submit the application in person);

Documents to be Submitted:
The original marital status confirmation issued by the commune-level People's Committee with authority in case the applicant for marriage registration does not have permanent residence registration at the commune-level locality performing the marriage registration procedures.
Documents to be Presented:
+ Passport or National ID card or Citizen ID card or other personal identification documents with a photo and personal information issued by a competent authority, valid for proving the identity of the applicant.
+ Documents proving the place of residence.
+ A divorce note extract in case a Vietnamese citizen residing permanently at the commune-level locality has had a prior divorce or marriage annulled abroad by a competent authority.
In addition to the documents mentioned above, depending on the specific case, the male or female party must submit the following corresponding documents:
- A Vietnamese citizen who divorced or annulled the marriage at the competent foreign authority must submit a copy of the civil status extract noting the divorce or annulment (Divorce note extract);
- A Vietnamese citizen who is an official and public employee or serving in the armed forces must submit a document from the managing agency/unit confirming that the marriage with a foreigner is not contrary to their sector's regulations;
- In case the applicant is working, studying, or laboring abroad for a fixed term, they must submit a Certificate of Marital Status issued by the diplomatic mission or consular office of Vietnam abroad. The documents to be presented include:
+ Passport or National ID card or Citizen ID card or other personal identification documents with a photo and personal information issued by a competent authority, valid for proving the identity of the Vietnamese citizen.+ Foreigners must present the original passport to prove their identity; if a foreigner does not have a passport, they can present an international travel document or residence card.+ Documents proving the place of residence to determine the authority for marriage registration. If the information on residence documents is already in the National Population Database, autofilled, then no presentation (in person) or uploading (online) is needed.
Procedures to Apply for a Marriage Registration Certificate
According to the provisions of Article 18 of the Civil Status Act 2014, the procedures to apply for a marriage registration certificate are as follows:
- Step 1: Both parties submit the marriage registration declaration form and the documents as specified in Section 2 to the civil status registration office and must be present together at the time of registration.
- Step 2: Immediately after receiving all the documents, if the marriage conditions are met according to the Law on Marriage and Family, the civil status official records the marriage in the Civil Status Register and both parties sign the Civil Status Register.
Both parties sign the Marriage Certificate; the civil status officer reports to the Chairman of the commune-level People's Committee to arrange for the issuance of the Marriage Certificate to both parties.
In cases where the conditions for marriage need to be verified, the resolution time shall not exceed 5 working days.
