What is the Lunar New Year 2024 Holiday Schedule?

- For Officials and Public Employees:

On November 22, 2023, the Ministry of Labor, Invalids and Social Affairs announced the holiday schedule for the Lunar New Year Giap Thin and National Day 2024 for officials and public employees as well as workers.

According to Announcement 5015/TB-LDTBXH-2023 by the Ministry of Labor, Invalids and Social Affairs (MOLISA), officials, public employees, and workers are entitled to the Lunar New Year 2024 holiday from Thursday, February 8, 2024 (the 29th of the lunar month of Quy Mao) to Wednesday, February 14, 2024 (the 5th day of the lunar month of Giap Thin).

(The Lunar New Year holiday includes 5 days of lunar holiday and 2 compensatory days for weekly rest days as stipulated in Clause 3, Article 111 of the Labor Code 2019).

- For Workers:

Based on the provisions of Article 112 of the Labor Code 2019, workers are entitled to 5 days off with full pay for the Lunar New Year.

In addition, Section 5 of Announcement 5015/TB-LDTBXH-2023 outlines the following options for the 2024 Lunar New Year holiday for workers:

- For the Lunar New Year holiday: Choose 1 last day of Quy Mao year and 4 early days of Giap Thin year or 2 last days of Quy Mao year and 3 early days of Giap Thin year or 3 last days of Quy Mao year and 2 early days of Giap Thin year.- Notify workers of the Lunar New Year holiday schedule at least 30 days in advance.- If the weekly rest days overlap with the holidays stipulated in Clause 1, Article 112 of the Labor Code 2019, workers are entitled to compensatory rest on the next working day as per Clause 3, Article 111 of the Labor Code 2019.- Employers are encouraged to adopt the same holiday schedule for workers as that for officials and public employees.

How is Work on Lunar New Year 2024 Compensated?

Based on the provisions of Article 98 of the Labor Code 2019, the regulations for overtime and night shift pay are as follows:

Overtime and Nightshift Pay

1. Employees working overtime are paid based on the wage unit price or the actual wage of the performed job as follows:

a) On regular days, at least 150%;

b) On weekly rest days, at least 200%;

c) On holidays, Tet holidays, and paid days off, at least 300% not including the wage of the holidays, Tet holidays, and paid days off for workers receiving daily wages.

2. Employees working night shifts shall be additionally paid at least 30% of the wage unit price or the actual wage of the performed job of a normal working day.

3. Employees working overtime during night shifts shall be paid an additional 20% of the wage unit price or the actual wage of the performed job of daytime work on normal working days, weekly rest days, or holidays, Tet holidays in addition to the pay stipulated in Clauses 1 and 2 of this Article.

4. The Government of Vietnam shall provide detailed regulations on this Article.

Therefore, employees working on Tet holidays are entitled to a pay rate of at least 300% in addition to their holiday pay for daily wage workers.

Furthermore, employees working night shifts receive an additional pay of at least 30% of their normal daily wage and 20% of their Tet holiday wage.

Thus, employees working during the Tet holiday 2024 are compensated as follows:

- Day Shift: At least 400% of their wage.- Night Shift: At least 490% of their wage.

Are Workers Entitled to Lunar New Year Bonuses in 2024?

Based on the provisions of Article 104 of the Labor Code 2019, the regulations regarding bonuses are as follows:

Bonuses

1. A bonus is a sum of money or assets or in other forms awarded by the employer to the employee based on the results of production, business, or the performance of the employee.

2. The bonus regulation is decided and made public by the employer after consulting the representative organization of employees at the workplace, where such organization exists.

Therefore, current laws do not mandate employers to award Tet bonuses to employees.

The Lunar New Year 2024 bonus will depend on the bonus policy issued by the company.

The form of the bonus will be decided by the employer and may include:

- Money.- Assets (items).- Other forms.
